8001( 7 PAGE 96 MINUTES OF THE ORANGE COUNTY BOARD OF COMMISSIONERS February 5, 1968 The Board of Commissioners of Orange County met in the Commissioners' Room of the Courthouse in Hillsborough, North Carolina on Monday, February 5, 1968 in regular session. Members Present: Chairman Harvey D. Bennett, and Commissioners William C. Ray, Ira A. Ward and Henry S. Walker. Members Absent: Commissioner Carl M. Smith. - Due to the absence of the clerk, S. M. Gattis, Acting Clerk, read the minutes of the January meetings. Same were approved by the Board. The following road petitions were received and the clerk was instructed to forward same to the State Highway Commission. They were: SR #1368, SR #1139, Edgewood Street (located off SR 1916), Luther Clayton Road and Tower Road - off Jones Ferry Road, and Road #1340. Harry Palmer of the Research Triangel Regional Planning Commission and Tyson Clayton, County Zoning Officer, presented to the Board the recommendations of the County Planning Board, said recommendations being adopted after the public hearing held on December 28, 1967. Dr. 0. David Garvin, District Health Officer, gave his approval of the proposed recommendations subject, however, to the proper administrative coordination and the overall implications. Upon motion of Commissioner Ray, seconded by Commissioner Ward, and unanimously adopted, Section 6.2 of the County Zoning Ordinance is to be amended as follows: Section 6.2 Minimum Lot Size 6.2.1 Lots served by both municipal or other community water and sewerage systems shall have a minumum size of fifteen thousand (15,000) square feet. 6.2.2 Lots not served by both municipal or other community water and sewerage systems shall have a minimum size of one (1) acre (except as provided in Section 11.3), provided, however, that this minimum may be reduced to twenty thousand (20,000) square feet only where the Orange County Planning Board shall determine the following facts: 6.2.2.1 That a soil survey of the proposed lot or lots has been conducted and an interpretation prepared by the Orange Soil and Water Conservation District, its designed representative or other authority acceptable to the Orange County Planning Board. 6.2.2.2 That the soil survey and interpretation shall show the following: (1) That there is an adequate area of suitable soils with a percolation rate of not less than 2 inches per hour for sewage absorption on each proposed lot. (2) That said absorption area shall not exceed fifteen (15) per cent in slope. (3) That hard rock is at least seven (7) feet below the bottoms of the filter trenches in the absorption area. (4) That the water table is at least seven (7) feet below the bottoms of the filter trenches in the absorption area. Note: These are interim provisions intended to serve until a complete soil survey of Chapel Hill Township can be accomplished. Upon motion of Commissioner Ward, seconded by Commissioner Walker, it was moved and unanimously adopted that the Board would accept the recommendations of the County Planning Board and would amend Section 12.1 lines 14-16 of the County Zoning Ordinance Section 12.1 (Page 15, Lines 14-16) P. 15, Section 12.1, lines 14-16 to be changed from "One calendar year must elapse before any member may be appointed for a subsecuent term of office" to "One calendar year must elapse before any member may be appointed for a subsecuent term of office, except that the one and two year appointees to the original Board may be re-appointed for one additional term."
