8001( 7 PAGE 96 <br />MINUTES OF THE ORANGE COUNTY <br />BOARD OF COMMISSIONERS <br />February 5, 1968 <br />The Board of Commissioners of Orange County met in the Commissioners' Room of <br />the Courthouse in Hillsborough, North Carolina on Monday, February 5, 1968 in <br />regular session. <br />Members Present: Chairman Harvey D. Bennett, and Commissioners William C. Ray, <br />Ira A. Ward and Henry S. Walker. <br />Members Absent: Commissioner Carl M. Smith. - <br />Due to the absence of the clerk, S. M. Gattis, Acting Clerk, read the minutes <br />of the January meetings. Same were approved by the Board. <br />The following road petitions were received and the clerk was instructed to <br />forward same to the State Highway Commission. They were: SR #1368, SR #1139, <br />Edgewood Street (located off SR 1916), Luther Clayton Road and Tower Road - off <br />Jones Ferry Road, and Road #1340. <br />Harry Palmer of the Research Triangel Regional Planning Commission and Tyson <br />Clayton, County Zoning Officer, presented to the Board the recommendations of the <br />County Planning Board, said recommendations being adopted after the public hearing <br />held on December 28, 1967. <br />Dr. 0. David Garvin, District Health Officer, gave his approval of the proposed <br />recommendations subject, however, to the proper administrative coordination and the <br />overall implications. <br />Upon motion of Commissioner Ray, seconded by Commissioner Ward, and unanimously <br />adopted, Section 6.2 of the County Zoning Ordinance is to be amended as follows: <br />Section 6.2 Minimum Lot Size <br />6.2.1 Lots served by both municipal or other community water and <br />sewerage systems shall have a minumum size of fifteen thousand <br />(15,000) square feet. <br />6.2.2 Lots not served by both municipal or other community water and <br />sewerage systems shall have a minimum size of one (1) acre <br />(except as provided in Section 11.3), provided, however, that <br />this minimum may be reduced to twenty thousand (20,000) square <br />feet only where the Orange County Planning Board shall determine <br />the following facts: <br />6.2.2.1 That a soil survey of the proposed lot or lots has been conducted <br />and an interpretation prepared by the Orange Soil and Water <br />Conservation District, its designed representative or other <br />authority acceptable to the Orange County Planning Board. <br />6.2.2.2 That the soil survey and interpretation shall show the following: <br />(1) That there is an adequate area of suitable soils with a <br />percolation rate of not less than 2 inches per hour for <br />sewage absorption on each proposed lot. <br />(2) That said absorption area shall not exceed fifteen (15) <br />per cent in slope. <br />(3) That hard rock is at least seven (7) feet below the bottoms <br />of the filter trenches in the absorption area. <br />(4) That the water table is at least seven (7) feet below <br />the bottoms of the filter trenches in the absorption area. <br />Note: These are interim provisions intended to serve until a complete soil survey <br />of Chapel Hill Township can be accomplished. <br />Upon motion of Commissioner Ward, seconded by Commissioner Walker, it was moved <br />and unanimously adopted that the Board would accept the recommendations of the <br />County Planning Board and would amend Section 12.1 lines 14-16 of the County Zoning <br />Ordinance <br />Section 12.1 (Page 15, Lines 14-16) <br />P. 15, Section 12.1, lines 14-16 to be changed from "One calendar year <br />must elapse before any member may be appointed for a subsecuent <br />term of office" to "One calendar year must elapse before any <br />member may be appointed for a subsecuent term of office, except <br />that the one and two year appointees to the original Board may be <br />re-appointed for one additional term." <br />
