7. The Common Area tract to be held in homeowner's association in perpetuity. and cannot be subdivided <br />or recombined with adjacent lots. <br />8. Either dedicate all of the land adjacent to Nine Gates Road to the NCDOT or place the land in the <br />Homeowner's Association as open space. <br />9. Submit verification that the requirements of NCGS Chapter 70 Article 3 Unmarked Human Burial and <br />. Human Skeletal Remains Protection Act have been met or will be met. <br />• Second Action: <br />• Planning Board consideration of the Preliminary Plat, on May 4, 2000, resulted in a tie vote (4-4). <br />• Planning Board discussion focused on the requirements for, and impact of, a Jones Ferry Road <br />turning lane. Planning Staff has recommended the need for a left turn lane. <br />• The Application is forwarded to the Board of County Commissioners with the Planning Board <br />minutes, and the Planning Staff recommendations and resolution for approval. <br />• Third Action: <br />Board of County Commissioners consideration of Preliminary Plat <br />1. The Board shall consider the application within a reasonable amount of time. <br />2. During deliberations and consideration of the application the Board may defer consideration at any point <br />to pursue additional analysis and review. <br />3. If the Preliminary Plat is approved by the County Commissioners the applicant shall have one (1) year <br />to prepare and file a Final Plat or to request a one -year extension from the Planning Director. <br />FINANCIAL IMPACT: Fiscal Impact Analysis (attached) <br />RECOMMENDATION (S): <br />Planning Staff_ <br />Approval in accordance with the attached resolution. <br />Planning Board <br />Tie vote: application forwarded to County Commissioners with Planning Board minutes, only. <br />Administration <br />Approval in accordance with the attached resolution. <br />(includes Resolution B. 6.
