57 <br />Now, Tl:erefore, the following represents the concessions, opinions and <br />agreements of the parties: <br />I. EXPANSION. <br />(a) In the event that the Application for expansion is approved, CAQE <br />believes and ASC and OWASA agree that the Conditions contained herein should <br />~, be made requirements of the expansion which will be accomplished by <br />incorporating them into ASC's Special Use Permit issued by Orange County. As <br />-~ shown on the map attached as Exhibit 1, the expansion of the quarrying operation <br />onto OWASA property .will be within the area indicated, which comprises <br />approximately twenty acres and as shown on Exhibit 1 shall include a minimum <br />500' buffer between the. blasting azea and the nearest. property line of contiguous <br />property not owned or leased by OWASA or ASC. Berm construction and other <br />uses aze allowed in this Buffer Area, but not blasting or stone processing. Along <br />with the additional area on the west side of existing Hickory Grove Bethel Church <br />Road, the total additional azea available for quarrying operations will be about <br />twenty six acres. The existing pit is about 23 acres. <br />(b) The expansion will be only in the area designated on Exhibit 1, west <br />of the relocated Hickory Grove Bethel Church Road. Under no circumstances <br />and at no time will ASC Quarry east of the relocated road. The road will be <br />relocated as shown on Exhibit 1 and will not be shifted east from the location <br />shown. <br />(c) ASC will seek a Special Use Permit from Orange County for the right <br />to mine in the expansion azea (but not the Buffer Area) for a term lasting until the <br />
