K -1 .a <br />meti=..by the::ather ,six c~tyarries located within ~~i25,~;~le radius; <br />W/:ereas, following encouragement from the Carrboro Board of Aldermen, the <br />parties hereto have sought to reach some level of agreement through the mediation <br />process; <br />Whereas, the parties ,hereto have participated in the mediation process in good <br />faith and have made a serious ,effort to understand the positions of the other parties <br />involved herein and to address such issues as have been brought before the mediation <br />process; <br />Whereas, as a result of the mediation process and the concessions made herein by <br />ASC and OWASA, which are represented by the non-highlighted portions of-this <br />document, CAQE, though they prefer that the expansion not take place, agrees not to <br />oppose the expansion, directly or indirectly, as long as ASC and OWASA abide by the <br />portions of this Memorandum which are not highlighted. <br />Whereas, OWASA wishes to continue to be mindful of, and work to minimize the <br />negative effects of its construction projects, operations and resouice management <br />practices on nearby persons, property and the community at lazge; <br />And, Whereas, there are some issues on which the parties agree and some issues <br />on which the parties do not agree, and the substance of those agreements and <br />disagreements is set forth in this Memorandum, which will be in full force and effect <br />during the teen of the quarry operation and which will terminate when quarrying ceases, <br />in no event later than the yeaz 2034., <br />
