5~ <br />MEMORANDUM OF AGREEMENT <br />This Memorandum of Agreement is entered into this/~ day of September, 1997 <br />by and between the Orange Water and Sewer Authority, a public body organized and <br />operating pursuant to the provisions of Chapter 162 A of the North Cazolina General <br />Statutes, hereinafter referred to as "OWASA"; American Stone Company, a North <br />Carolina corporation with its principal place of business in Orange County, hereinafter <br />referred to , as "ASC"; and Citizens Against Quarry Expansion, an association of <br />citizens including but not limited to Rem Malloy, Anne Parrish and Erwin Danziger, who <br />live ar awn property in the vicinity of the American Stone Quarry, referred to as <br />"CAQE". <br />WITNESSL~TH: <br />Whereas, in 1991 ASC filed an application with the various local governments <br />seeking to expand its existing quarry operation; .. <br />Whereas, OWASA has joined with and supports ASC's Application far <br />Expansion contingent on receiving the quarry pit at the end of the term of quarrying; <br />Whereas, CAQE has opposed that applicatign; believing that •ao' public`paYp~~e~ ~s <br />served:and. such expansion is detriffiental~to the environument; <br />...s-::::Whereas, CAQE believes~=there':•is no _•scarcity'iof• water and :iha.~ the :'OWASt~ <br />projections for water demand .are overstated . and; the •: supply ~:bf~ water :sources.: are <br />understated; <br />
