4 <br />Alice Durham. The subject area is located in Bingham Township along the northern side of NC 54, <br />bath east and west of its intersection with Bethel~Iiickory Grove Church Road (SR 1104). <br />The proposed amendments which will be considered jointly are summarized as follows (PIN refers <br />to property identification number): <br />JPA-1-00 requests a 75.20 acre expansion of the extractive use plan category as contained in <br />the JPA Land Use Plan. The extractive use category encompasses mizung and quarry operations. <br />The application requests that the extractive use category be extended to a 15.20 acre parcel (PIN <br />9759-63-9813) owned by American Stone Company and a 60 acre pazcel (PIN 9759-62-1992) <br />owed by OWASA. Amendments to the JPA Land Use Plan require the approval of Chapel Hill, <br />Cazrbaro, and Orange County as specified in the Joint Planning Agreement. <br />CP-7.-00 requests the establishment of a 150.51 acre rural industrial activity node. A rural <br />industrial activity node is land focused on designated road intersections in the rural areas that is <br />appropriate for industrial uses which do not require urban-type services. The request includes the <br />properties referenced in JP-1-00 as well as five acres of a parcel (P1N 9757-44-2780) owned by <br />American Stone Company and a 100.31 acre parcel (PIN 9759-54-4097) owned by Philip and <br />Alice Durham (American Stone leases this property and operates an existing quarry there under a <br />Special Use Permit issued October 23, 1981). Comprehensive Plan amendments require only the <br />approval of the Orange County Commissioners. <br />Almost identical amendments, JPA-1-91 and CP-3-91, were considered at a Joint Public Hearing <br />on October 10, 1991. Concern with potential environmental impacts was raised during the public <br />hearing process. Two particular areas of concern dealt with the. proposed relocation of an existing <br />asphalt plant (currently located on the 15.20 acre parcel identified by PIN 9759-63-9813 ~- this is <br />now moot) and the effects of blasting on surrounding properties. <br />Though not a requirement of the plan amendment process, the applicants chose to prepare and <br />submit an Environmental Impact Statement (EIS) as specified in the Orange" County Environmental. <br />Impact Ordinance. The EIS was presented at a JPA Public Hearing held on October 14, 1993. <br />Following that hearing, the applicants decided to withdraw the proposal for relocating the, asphalt <br />plant. An updated and supplemental EIS was submitted in March 2000 to address water resource <br />options and mitigation measures. <br />At 'a Joint Public Hearing held on April 14, 1994, amendments JPA-1-94 and CP-1-94 were <br />considered. These were the same as the amendments presented in 1991 except that the 42.67 acre <br />tract identified by PIN 9759-73-5215 proposed for the relocation of the asphalt plant was removed <br />from consideration. <br />The Cazrboro Board of Aldermen determined in August 1994 that they would take no further action <br />until American Stone, OWASA, and citizens opposed to the quarry expansion had undertaken a <br />mediated dispute resolution process. Mediated discussions facilitated by the Dispute Settlement <br />Center began in June 1996 and continued through 2l separate sessions over the ensuing 10 <br />h:\jpa\amstab00.doc\4-6-00\gb z <br />
