z <br />MEMORANDUM OF AGREEMENT BETWEEN <br />THE UNIVERSITY OF NORTH CAROLIlVA AT CHAPEL HILL <br />CHAPEL HII,L, NORTH CAROLINA <br />for the <br />DEPARTMENT OF DENTAL ECOLOGY <br />in the <br />SCHOOL OF DENTISTRY <br />and <br />Orange County Health Department <br />for the <br />Smart Start Grant <br />I. PURPOSE <br />This document is a Memorandum of Agreement between The University of North Carolina. at <br />Chapel Hill, for its Department of Dental Ecology in the School of Dentistry, hereafter referred to <br />as the "University,"' and Orange County Health Department, hereafter referred to as the "OCHD", <br />for the purpose of providing a Project Director for its Smart Start Grant awarded by the Orange <br />County Partnership for Young Childrem, hereafter referred to as "OCPYC". <br />II. EFFECTIVE DATES <br />This agreement shall be effective as of April 1, 2000 and shall remain in effect until. June 30; 2000 <br />unless terminated as set forth below. Either party may request a change in the terms of this <br />agreement. Any agreed to change to this agxeemelrt must be approved by both parties' written <br />endorsement thereto. Either party may terminate this agreement by giving the other party 30 days <br />written notice in advance of the desired termination date. <br />III. GENERAL AGREEMENT <br />During the performance of this agn~rient, both parties agree as follows: <br />A. The OCHD hereby agrees with the University that, in its educational and/or employment <br />practices, said contracting party will not discriminate against any person because of race, <br />color, religion, sex, national origin, age, or disability. <br />B. The OCHD will not be responsible for damages arising from personal injury to students of <br />the University while they are present at the OCHD unless personal injury was caused by <br />the negligence of the OCHD, its employees, or agents. <br />C. In the event the student is exposed to blood or body fluids, the OCHD will be responsible <br />for providing an initial response, according to the Institution's Blood-Borne' Pathogens <br />Standard. The student will be required to return to University of North Carolina Student <br />Health Services for post-incident testing and counseling if feasible. In the event the student <br />is unable to do so in a timely manner, the OCHD wall provide access to testing and <br />counseling for the student. The student wall be responsible for the payment of services, but <br />will be able to request reimbursement from the University. <br />D. The University will be responsible for the negligence of its employees and agents to the <br />extent permitted by the North Carolina Tort Claims Act. <br />E. The OCHD shall pay the University $12,000 by June 30, 2000 upon receipt of the <br />University's invoice. The University shall invoice the OCHD no later than June 15, 2000. <br />
