<br />C-2 <br />Section 4. The.work to be done under this agreement will be <br />staked out by the Assistant Engineer. The Contractor will be <br />required to furnish him with all necessary assistance in giving lines <br />and grades, and all lines, stakes, nails,.fastenings, etc., and the . <br />Contractor will be required to carefully preserve all stakes and <br />grades until authorized to remove then. The Contractor shall also <br />furnish all proper and necessary assistance for inspecting the <br />completed work. <br />Section 5. The work shall be commenced not later than <br />?? "US f S <br />and diligently prosecuted to completion &0 e) <br />without allowance for bad weather. Should the work or delivery of <br />materials be interrupted or delayed by the party of the first part, <br />the time of completion shall be extended by the amount of time of <br />said delay or interruption. It is further agreed that the Hoard shall <br />have the right at its discretion to extend the time for the completion <br />of the work. <br />Section 6. The Contractor agrees not to employ any incompetent <br />or disorderly person on the work, but will employ competent, experi- <br />enced foremen to be in charge of their respective work. <br />Section 7. To prevent all disputes and litigation, it is <br />agreed by and between the parties. to this contract that the Engineers <br />shall in all cases determine the quality and quantity of the several <br />kinds of work and materials which are to be paid for under this <br />contract, and he shall.determine all questions in relation to lines, <br />levels, and dimensions of the work, and as to the interpretation of <br />the plans and specifications. <br />Section 8. The party of the first part through the Engineers, <br />shall have the right, without notice to Sureties on the Contractor's <br />Bond, to make any alterations in the plans or quantity of the work or <br />materials herein contemplated, and it is expressly agreed and under- <br />stood that such alteratirns, additions, modifications, or omissions, <br />shall not in any way violate this contract, and the Contractor hereby <br />agrees not to claim or bring suit for any damages, whether for loss of <br />profit or otherwise.. Whenever Quriuy tLe-prvgresc•of the work any <br />additional work or materials, or changes or modifications in the work <br />or materials contracted for, are agreed upon between the said Board <br />and the Contractor, such additional work or materials, alterations <br />or modifications shall be considered and treated as though originally <br />contracted for an shall be upon and subject to all terms, conditions <br />and provisions of the original contract. <br />Section 9. whenever the Contractor is not upon any part of the <br />work where it is desired by the Engineers to give instructions, the <br />superintendent or Poreman,. who may be in charge of that particular <br />
