Minimum building setbacks shall be as indicated on the Preliminary Plan. The setback <br />requirements shall be stated on the plat, and in a document describing development restrictions <br />an requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. <br />4. Lot 5 shall be designated as open space and deeded to the homeowners association. <br />5. Sign easement location to be shown on final plat. The developer does not want to combine lots five and six or designate it as open <br />space because they would like to use the suitable soil from the road construction waste material to enhance the <br />existing soils so that it ,,may be a viable lot at a later time. He said that he asked the Environmental Health <br />Department to commeat on this and they have indicated that it is not feasible for soils to be transplanted onto lot <br />five. The second item of contention is that the access from Old Forest Drive is a right-of-way stub out from the cul- <br />de-sac in Wyngate su?ivision to the north. The Planning staff is recommending that the developer construct the <br />road to state standards. He referred #2 of the First Action Conditions on page 54 of the agenda packet and said that <br />Fire Marshal Mike Tapp and the NCDOT would prefer that the connection be paved. He said that the Planning staff <br />recommendation is approval of the resolution along with the three conditions at the bottom of page 54 of the agenda <br />packet. <br />Strayhorn said that he did not understand why the connection needed to be paved. He thought the Planning Board <br />had discussed it not being paved. He would like to hear Mike Tapp's explanation. g <br />Chair Barrows said tha? when the Board heard the plan and decided on the condition #2, they were trying to listen to <br />the residents, but they were also mindful ofNCDOT.
