<br />S <br />WHEREAS, Barber & Ross Company has nearly completed its up- <br />fitting of the Redman homes building and has constructed <br />all of the sewer system extension with the exception of the <br />portion which passes under the railroad and through the <br />railroad right-of-way. <br />NOW, THEREFORE, the Orange County Board of Commissioners do <br />hereby (1) approve, in substantially their present form, the <br />following agreements: Barber & Ross Company Agreement and Sewer <br />Easement; Norfolk Southern Railway Company Agreement; and North <br />Carolina Railroad Company Agreement and Consent; (2) authorize <br />the County Attorney and County staff to continue working with <br />the railroads to improve the agreements relative to ultimately <br />providing sewer service to the Buckhorn Road EDD; and (3) <br />authorize the County Manager to execute the agreements with the <br />railroads and with Barber & Ross Company in substantially the <br />form of the agreements attached to this Resolution when those <br />agreements are finalized. <br />This the 18th day of January, 2000. <br />lsg:orangecounty/barber&ross.res
