<br />Jan-12-00 OS:18P Coleman Gledhill Hargrave 919 732 7997 <br />21 <br />licensee of the portion of its property where this sewer line <br />crossing will occur.; and <br />WHEREAS, the Norfolk-Southern Railway Cornp:Any License <br />Agreement and the Forth Carolina Railroad Agreement and Conserit <br />require Orange County, as owricr of the lic:crise, to indemnify and <br />hold harmleas both Norfolk-Southern Railway Company and the <br />North Carolina Railroad with respect to the installation, <br />maintenance, operation and removal of the sewer system crossing <br />the railroad property; and <br />WHEREAS, the Norfolk--Southern Railway Company License <br />Agreement and the North Carolina Railroad Agreement and Consent <br />require Orange County to pay certain fees in consideration for <br />the granting oL the license and consent; and <br />WHEREAS, Orange County anticipates that this railroad <br />crossing will ultimately be the crossing for so much of the <br />Bfland Area Sewer System that will service the ©uc:khorn Road <br />Economic Development District; and <br />WHEREAS, iC is in the best interest of Orange County and <br />Barber & Ross to use this railroad crossing for the future <br />expansion of the Efland Area Sewer System to include the entire <br />Buckhorn Road Economic nevelopmcnt Distric_L area.
