Jan-12-00 05:18P Coleman Gledhill HargravQ 919 732 7997 <br />Ate,e <br />NORTH CAROLINA <br />ORANGE COUNTY <br />AGREEMENT AND SEWF..R EASEMENT <br />This Agreement and Sewer Easement, made and entered into <br />zp <br />Lhi.s the day of 2000 by and between the <br />County of Orange, North Carolina, a political subdivision of the <br />State of North Carolina, having its principal office at 208 S. <br />Cameron SCreet, Hillsborough, North Carolina, hereinafter <br />referred to as "Orange County," and Barber & Ross Company, Inc., <br />a Virginia corporation having its principal office in Leesburg, <br />Virginia, hereinafter sometimes referred to ORarber & Ross;" <br />WHEREAS, Orange County and Barber & Moss have previously <br />entered into a Utility Extension Fund Agreement, a copy of whicli <br />is Exhibit A hereto; and <br />WHEREAS, the connection of the Efland Area Sewer System to <br />the Barber & Ross facilities requires the installation of a <br />three inch diameter sanitary sewer forcemain within a twelve <br />inch diameter casing pipe under and across the right-of-way or <br />property of Norfolk-Southern Railway Company and the North <br />Carolina Railroad; and <br />WHEREAS, Norfolk-Southern Railway Company and the North <br />Carolina Railroad are requiring Orange: County to became the
