Norfolk Southern requires that the agreement covering such a connection be with a <br />public body rather than a private entity. The attached Resolution (Attachment A) authorizes the <br />County Manager to sign the agreements with Norfolk Southern (Attachment B) and with the <br />North Carolina Railroad (Attachment C), and the attached Agreement (Attachment D) spells out <br />the obligations of the County and Barber & Ross regarding this matter. <br />BACKGROUND: <br />As previously authorized by the Board of County Commissioners, Barber & Ross is connecting <br />its sanitary sewer stream to the Efland Sewer System by constructing a pump station and <br />running a 3-inch pipeline to the nearest manhole on Route 70. This project requires boring <br />under the railroad owned by the North Carolina Railroad and leased to Norfolk Southern. <br />Because of the difficulty of securing railway permits, the agreements ensure that the proposed <br />boring and pipe casing will serve as the connector if and when sewer is extended throughout <br />the Economic Development District. Accordingly, the County and Barber & Ross have agreed <br />that: <br />• Barber & Ross will purchase and maintain the required liability insurance covering the <br />pipeline, and will indemnify the County to the extent of the insurance limits;
