40 <br />4. All common areas including landscape buffers must be clearly identified on the preliminary and fmal <br />plats and maintained by the Homeowners Association. The common areas cannot be subdivided or <br />recombined with adjacent lots. Draft forms of the Homeowners Association documents, including <br />restrictive covenants and conservation easements, that contain use and maintenance provisions for the <br />open space and buffers must be submitted for review by the County Attorney as part of the <br />preliminary plat approval process. The restrictive covenants or conservation agreements shall <br />designate a backup grantee in the event that the Homeowners Association is eliminated. <br />5. The preliminary and final plats shall contain a note restricting further subdivision. <br />6. The applicant must receive approval from Orange-Alamance to extend public water services from the <br />Orange-Alamance Water System into the James Woods Subdivision or make provisions for <br />individual wells on each proposed residential lot. <br />7. Each lot shall contain an adequate area for septic disposal and a repair area as approved by the <br />Orange County Division of Environmental Health. <br />8. The preliminary plat shall indicate areas for on-site infiltration of storm water that demonstrates <br />compliance with Article 6.23.3a of the Orange County Zoning Ordinance. <br />9. The preliminary plat shall show the location of tree protection fencing and contain a note requiring <br />the installation of tree protection fencing prior to any grading to ensure the protection of vegetation <br />within all buffers and open space. <br />10. The applicant shall dedicate a minimum of 24,394 square feet (1/57 acre per residential lot) for public <br />recreation space, or pay an in-lieu-of fee, as part of the preliminary plat approval process. (Section <br />IV-B-7-b Recreation Sites, Orange County Subdivision Regulations). <br />11. The applicant shall provide a minimum of 36,852 square feet for private recreation space as part of <br />the preliminary plat approval process. (Section IV-B-7-b Recreation Sites, Orange County <br />Subdivision Regulations). <br />12. All street names to be reserved with GIS section of Planning Department prior to submittal of <br />preliminary plat subdivision request. The applicant must resolve any issues regarding the future <br />connection of James Woods Drive with High Ridge Drive prior to preliminary plat submittal. <br />Second Action: Planning Board to consider Preliminary Plan <br />Options: 1. Action within two regularly scheduled meetings or; <br />2. Within such further time consented to in writing by the applicant. <br />3. If the Planning Board renders a tie vote, or fails to act within the specified period, <br />approval of the Concept Plan is directed to the Board of County Commissioners with the <br />Planning Board's minutes and staff's recommendations. <br />FINANCIAL IMPACT: A Fiscal Impact Analysis (attached) <br />RECOMMENDATION(S): Staff Recommendation <br />5 <br />
