General Provisions <br />(To be re-numbered) <br />New subsection-9.3: (Note: Sub-sections presently numbered 9.3 and following <br />will have to be re--numbered) <br />9.3 Undersized Lots in Recorded Subdivisions <br />The Orange County Board of Adjustment shall be empowered to authorize the <br />issuance of zoning permits for single-family residential structures on lots <br />in a Residential District even though such lots do not meet the requirements <br />of said district, whenever it shall make all the following findings of fact: <br />(a) That the subdivision plat was filed as a legal record in the office <br />of the Orange County Register of Deeds prior to February 6, 1967, the <br />effective date of this ordinance; <br />(b) That the lots are no smaller than 15,000 square feet; <br />I <br />(c) That streets in said subdivision have been cleared and graded; <br />(d) That a substantial number of. lots have been sold in the subdivision; <br />(e) That the lots are served by a community-type water supply approved in <br />writing by the District Health Director." <br />The Planning Board recommended that Community Airports be permitted in <br />residential districts, but that a Community Airport permit must be issued by the <br />Board of Adjustments. Discussion ensued concerning other proposed amendments to <br />the zoning ordinance. Upon motion of Commissioner Walker, seconded by Commissioner <br />Ray, it wa's moved, that the following amendments classified as section 6.1 and <br />Section 10 be adopted. <br />"Amendments to the Cha el Hill Township Zoning Ordinance <br />Adopted June 7, 1967) <br />Section 6.1 Include: <br />Residential <br />Districts <br />Community Airports (as permitted X <br />in Section 10) <br />Section 10 Community Airports <br />(New Section - requires re-numbering of other ordinance Sections) <br />The Orange County Board of Adjustment shall be empowered to issue Community <br />Airport Permits when it shall make the following findings: <br />(a) That the minimum lot size shall not exceed acres; <br />(b) That a buffer strip of not less than 100 feet, measured from all exterior <br />property lines and main-travelled roadway right-of-way lines, within which <br />no structure shall be erected nor taxiing or other aircraft movement, <br />storage or repair shall be permitted. <br />(c) All automobile and other non-aircraft parking shall be provided off the <br />highway right-of-way, but may be provided within the buffer strip; <br />(d) No signs shall be permitted except identification, occupancy, and real <br />estate; <br />(e) That there shall be outdoor and/or indoor storage for no more than 10 <br />aircraft, including temporary or overnight storage; <br />(€) That there shall be only one runway; <br />(g) That the runway shall be no longer than feet. <br />The Board of Adjustment shall impose such reasonable and appropriate terms, <br />conditions, safeguards and requirements upon the issuance of a Community <br />Airport Permit as it may deem necessary to protect the public and neighboring <br />property owners against adverse effects, including the requirements that there <br />be no violation of the above findings.
