"' ~'-' I UwIV tif~LL <br />j <br />Section 14-41 Vio ' <br />(a) The Town shall enforce the limits established by this Article by reading <br />interruptible subscribers' meters as often as the Town deems necessary and, if necessary, <br />terminating service to interruptible subscribers. <br />(b) An interruptible subscriber shall be in violation of this Article if any meter <br />reading indicates cumulative consumption in excess of the average .daily consumption <br />limits which have been applicable to the subscriber since the effectiveness of such limits. <br />Example: An intenvptible subscriber has an average daily consumption of 100,000 <br />gallons per day, If the stage four, fifty percent Limit was in effect for five days and the <br />stage five, ten percent limit was in effect for five days, and if the meter was read after ten <br />days of effectiveness, the subscriber would be in violation if the meter showed <br />consumption of more than 300,000 gallons. <br />5 days x 50,000 gallon limit = 250,000 gallons <br />5 days x 10,000 gallon limit = 50.OQO gallons <br />300,000 gallons <br />(c) Upon any violation of the prescribed limits, the Town may suspend water service <br />to the subscriber as long as the stage four water shortage DANGER, or any more serious <br />water shortage condition, continues. <br />~~n 14-41.1 Pensltis~ <br />(AMENDED 0&27-02) <br />a) A violation of any of the provisions of this ordinance shall constitute a <br />misdemeanor, punishable by a fine not ,to exceed $50.00 or imprisonment not to exceed <br />thirty days, as provided by N.C. General Statutes Section 14-4. <br />b) A violation of aay of the provisions of this ordinance shall also subject the <br />offender to a civil penalty of $10.00 for violations duri~ttg stage III, $25.00 during stage <br />IV, and $50.40 during stage V, and $150.00 during stage YI. If a person fails to pay this <br />penalty within ten days after being cited for a violation, the Town may seek to recover <br />the penalty by filing a civil action in the nature of debt. <br />c) The Towa may seek to enforce this .ordinance through any appropriate equitable <br />action. <br />d) Each day that a violation continues after the offender has been notified of the <br />violation shall constitute a separate offense. <br />e) With respect to customers of the Town's water system that are located outside the <br />Town's Corporate Limits, and who are thezefore not subject to the penalties set forth in <br />Subsection a) and b) above, the Town may discontinue service to such customers upon a <br />determination by the Board of Commissioners that any such customer has violated the <br />provisions of this Ordinance. <br />fl The Town may seek to enforce this ordinance by using any one or any <br />combination of the foregoing remedies. <br />
