�6 <br />Section 12. Board of Adjustment <br />12.1 Creation of the Hoard <br />A Board of Adjustment is hereby established. Such Board <br />shall consist of five (5.) members and two alternate <br />members, residents and citizens of Orange County, and <br />appointed by the Orange County Board of Commissioners. <br />The Vice- Chairman of the Orange County Planning Board <br />shall be ex- officio a member of the Board of Adjustment, <br />with full rights and privileges. Alternate members <br />shall vote only in the absence Of regular members and <br />shall serve in rotation. Members of the Board of <br />Adjustment will be appointed to terms of three (3) years, <br />except that the original Board shall be appointed to <br />serve terms as follows: one member.three (3) years, two i <br />members two (2) years each, and two.members one (1) year <br />each. One calendar year must elapse before any member <br />may be reappointed for a subsequent term of office. <br />Vacancies shall be filled as they.occur and to serve <br />for the expiration of the unexpired term. The members <br />of the Board of Adjustment shall receive no compensation <br />for their services, but shall be reimbursed for "out of <br />j pocket" expenditures made in connection with their <br />duties. <br />12.2 Rules of Procedure <br />i <br />The Board of Adjustment is a quasi - judicial administra- <br />tive body whose decisions affect private property rights <br />to the same extent as court decisions. For that reason <br />it shall promptly adopt rules of procedure which must <br />be regular and properly judicial, and its decisions must <br />be in accordance with the recognized body of law in its <br />field and its rules of procedure. To comply with <br />statutory and case law, at least the following provisions <br />must be included: <br />! 12.2.1 The Board shall•fix the time within which <br />notices of appeal from the zoning Officer's <br />1 decision must be filed by.the property <br />owner. <br />12.2.2 The Board shall make provisions for the giving <br />of notice prior to hearing.the appeal. <br />12.2.3 The Board shall fix a ressonable'time within <br />which the appeal must be heard. <br />I . <br />12.2.4.. The quorum for the purpose of hearing cases <br />shall be not less than four members. <br />12.2.5 The concurring vote of not less than four <br />members shall be necessary tot <br />
