The site is surrounded to the west and <br /> north by property owned by Duke University. The buffer easement from Duke University allows <br /> for a larger C&D landfill to be located on property the County now owns and property it will <br /> acquire. The buffer also provides the County the opportunity to achieve a site plan for the <br /> expanded C&D landfill that is more compatible with the community where the C&D landfill is <br /> located in its design and in the fact that it will provide a buffer to property adjacent to County <br /> solid waste activities. <br /> Following preliminary discussions with the State Division of Waste Management and its <br /> attorney, it was concluded that Orange County could utilize an off-site buffer on Duke University <br /> property if an easement could be acquired. Duke University agreed to such an arrangement. <br /> The attached Deed of Easement is a result of negotiations between the University and Orange <br /> County in this regard. The University has approved and fully executed the document. <br /> FINANCIAL IMPACT: Duke University has provided the easement at no direct cost to Orange <br /> County. A survey of the easement was provided by Orange County and some nominal buffer <br /> maintenance conditions are included in the easement, which will be paid from the Solid Waste <br /> Enterprise Fund operating budgets. <br /> RECOMMENDATION(S): The Manager recommends that the Board approve the Deed of <br /> Easement and authorize the Chair to execute the Deed of Easement with Duke University. <br />
