9 <br />Section 3. Service Area <br />A. The Grantee's Service Area shall consist of the unincorporated areas located <br />within the County as may be amended from time to time as the result of <br />annexation of territory by incorporated municipalities located within the County. <br />B. The Grantee shall provide Cable Service to all locations within the Service Area <br />where the dwelling density is 18 homes per mile or greater, except as provided by <br />Section 4A. <br />Section 4. Cable System Service Area Extension <br />A. The Grantee shall install its Cable System (excluding only Drops to individual <br />dwelling units) in all new subdivisions, condominiums or developments on the <br />earlier of the date on which electric facilities or the date on which telephone <br />facilities are installed in such subdivisions, condominiums or developments, such <br />that Grantee shall be able to provide Cable Service to any dwelling unit in such <br />subdivision, condominium or development solely by the installation of a "drop <br />wire" to the Subscriber premises after such dwelling unit has been constructed <br />and a certificate of occupancy issued. <br />B. The Grantee shall extend service beyond its Initial Service Area to any household <br />where the number of occupied homes, and homes for which certificates of <br />occupancy have been issued equals at least eighteen (18) homes per street mile <br />with the measurement starting from the closest Cable System node. <br />1. This extension beyond the Grantee's Initial Service Area shall be <br />completed within three (3) years from the effective date of this <br />Agreement. The Grantor may approve additional time subject to a written <br />request by the Grantee that delineates the case for additional time. <br />2. Periodically the Grantor may direct the Grantee to extend its Cable System <br />to serve areas, such as new housing developments, where the density <br />standard is met. Such extensions shall be completed within twelve (12) <br />months from the date of notification. The Grantor may approve additional <br />time subject to a written request by the Grantee that delineates the case for <br />additional time. <br />B. If the number of households per street mile is less than eighteen (18), the <br />requesting resident(s) may obtain service by paying a share of the incremental <br />cost of the extension as follows: <br />The Grantee shall pay a share of costs calculated as the fraction derived <br />from the existing density as calculated above divided by eighteen (18) <br />homes per mile; requesting Subscriber(s)' share shall equal the remainder. <br />For example, if the line extension density is nine (9) homes per mile, the <br />8/22/2003 <br />
