6 <br />I. "Cable Operator" shall mean any person or group of persons who: <br />1. provide Cable Service over a Cable System and directly or through one or <br />more affiliates owns a significant interest in such Cable System, or <br />2. otherwise control or are responsible for, through any arrangement, the <br />management and operation of such a Cable System under a Franchise with <br />the Grantor. <br />J. "Cable Service" shall mean: <br />1. The transmission to Subscribers of (i) video programming, or (ii) other <br />Internet Protocol video program service, and <br />2. Subscriber interaction, if any, which is required for the selection or use of <br />such video programming or other programming services. <br />K. "Cable System" shall mean a facility, consisting of a set of closed transmission paths <br />and associated signal generation, reception, and control equipment that is designed to <br />provide Cable Service and Other Communications Services provided to multiple <br />Subscribers within a community, but such term does not include: <br />1. A facility that serves only to retransmit the television signals of one (1) or <br />more television broadcast stations; <br />2. A facility that serves Subscribers without using any Public Right-of--Way; <br />3. A facility of a common carrier which is subject, in whole or in part, to the <br />provisions of 47 U.S.C. §201-226, except that such facility shall be <br />considered a Cable System, other than for purposes of 47 U.S.C. §541(c), <br />to the extent such a facility is used in the transmission of video <br />programming directly to Subscribers; and <br />4. Any facilities of an electric utility used solely for operating its electric <br />utility system. <br />L. "Channel" shall mean a portion of the electromagnetic frequency spectrum, which is <br />capable of delivering both the audio and video portions of a television signal. Such <br />capability generally requires a bandwidth of 6 MHz. <br />M. "County" shall mean Orange County. <br />N. "Customer Service Standards" shall mean those standards adopted by the FCC, <br />which govern the manner in which the Grantee interacts with the public and its <br />customers. <br />8/22/2003 <br />
