15 <br />a. That in determining whether existing use is continuous and <br />warrants additional PEG Access channel capacity, the use of repeat <br />programming and text or character-generated programming shall <br />not be considered; <br />b. That when technically and economically feasible alternatives are <br />available, the Grantee shall be given the opportunity to <br />accommodate further channel usage for PEG Access purposes <br />without dedicating a specific channel for PEG Access. <br />E. Programs telecast on the PEG Access channels shall be noncommercial in nature. <br />Program material to be distributed on PEG Access channels shall contain no <br />advertising or commercial content for which consideration of any kind is received <br />directly or indirectly by the Grantor or by the producer or distributor of a <br />program. The Grantor may not enter into a lease, license, contract or arrangement <br />of any kind whereby the Grantor or its designee allows or requires any Person to <br />program all or part of a PEG Access channel in exchange for consideration of any <br />kind. Program material to be distributed on PEG Access channels shall: <br />1. Be produced or provided in pre-produced form by any County resident or <br />produced or provided by any agency, public or private, serving County <br />residents regardless of the location at which the programming originated; <br />and <br />2. Allow for public expression relating to educational, political, social, or <br />cultural interests of the residents of the County. <br />F. The Grantor may designate locations from which PEG Access programming may <br />be originated and provided to the Grantee for distribution on the designated PEG <br />Access channel(s), subject to the following conditions: <br />1. There may be one permanent Public and Education Access origination <br />location for each designated PEG Access channel; <br />2. The Grantee shall not be obligated to extend its facilities from its existing <br />Cable System distribution plant more than one hundred twenty-five (125) <br />feet to each Public or Education Access origination location or furnish any <br />internal wiring, modulator(s), or associated equipment. <br />3. PEG Access signal transportation from the permanent PEG Access <br />origination location(s) shall be provided without charge to the Grantor by <br />the Grantee. <br />4. The Grantee may incur expenses to provide signal transportation, routing <br />and switching attributable to PEG Access channel carriage. At its <br />8/22/2003 <br />
