14 <br />acceptable form. The electronic version must be based upon NC State Plane <br />Coordinates. <br />Section 12. Public, Education and Government Access Provisions <br />A. The Grantee shall continue to provide the current number of PEG Access <br />channels available to the Grantor as of the effective date of this Franchise. <br />B. On October 1, 2003 or upon ninety (90) days following the effective date of this <br />Franchise, the Grantee shall designate a PEG access channel for sole use by the <br />County for County wide live and recorded telecasts of Orange County Board <br />meetings and other Government Access television programs. This channel may <br />appear on an upper or expanded basic service tier until such time, but no later than <br />January 1, 2004, the Grantee performs channel realignment, whereupon the <br />Orange County Government Access channel shall be placed on the Basic Service <br />Tier. <br />C. The Grantee shall design its system and install equipment at its sole expense to <br />provide signal transportation for County Board meeting telecasts on a designated <br />PEG channel that originate from the: <br />1. Southern Human Services Center at 2501 Homestead Road, Chapel Hill, <br />NC and the <br />2. F. Gordon Battle Courtroom, Orange County New Courthouse at 106 East <br />Margaret Lane, Hillsborough, NC. <br />D. After July 1, 2004, the Grantor may require the Grantee to designate a fifth and <br />sixth PEG channel(s) to provide up to six (6) PEG Access channels for use by the <br />Grantor or its designee(s). The PEG Access channels shall be used for non- <br />commercial, public, education and government purposes. The Grantee shall <br />select PEG Access channel number assignments. The Grantor shall determine <br />which PEG Access channels assigned by the Grantee are to be used for which <br />PEG Access purpose. PEG Access channels shall be made available by the <br />Grantee for use as provided for herein, by the Grantor and its residents in <br />accordance with the rules and procedures established by the Grantor or any <br />lawfully designated person, group, organization or agency authorized by the <br />Grantor for that purpose. <br />1. Whenever the current PEG Access channel(s) are in continuous use from <br />4:00 p.m. to 11:00 p.m. for six (6) weeks running, the Grantor may, with <br />ninety (90) calendar days written notice, request the fifth and sixth PEG <br />Access channel. The Grantee shall be required to provide additional <br />capacity for such PEG Access channel(s) when such continuous use has <br />existed, provided, however: <br />R/22/2003 <br />
