ORANGE COUNTY <br />BOARD OF COUNTY COMMISSIONERS <br />ACTION AGENDA ITEM ABSTRACT <br />Meeting Date: October 18, 2005 <br />Action Agen5da~ <br />Item No. <br />SUBJECT: Boundary Survey for Keith Conservation Easement and Exemption from <br />Selection Process <br />DEPARTMENT: Environment and Resource PUBLIC HEARING: (YIN) No <br />Conservation <br />ATTACHMENT(S): <br />None <br />INFORMATION CONTACT: <br />David Stancil, 245-2590 <br />Pam Jones, 245-2650 <br />Rich Shaw, 245-2591 <br />PURPOSE: To authorize the hiring of ENT Land Surveys, Inc, for completing a boundary <br />survey of the Charles Keith property for which Orange County is purchasing a conservation <br />easement and to exempt the County from the provisions of G.S. 143, Article 3D in order to <br />expedite survey work needed for the proposed easement acquisition, <br />BACKGROUND: On September 7, 2005, the Board of Commissioners authorized the <br />County's purchase of a conservation easement for 36 acres owned by Dr. Charles Keith, <br />A boundary survey of the easement area is needed for a plat that will be recorded with the <br />conservation easement, County policy requires Board approval for expenditures with <br />licensed professionals, specifically architects, engineers and surveyors. ERCD has worked <br />with the Purchasing and Central Services to select a firm to perform the survey services. <br />G.S, 143, Article 3D allows counties to exempt themselves from a selection process far <br />surveyors on any project if the professional fee will be less than $30,000, or, in their <br />discretion, on any project by stating the reasons therefore, In order to expedite the survey <br />work and since the cost of work is estimated to be less than the $30,000 threshold, it is <br />recommended that the County exempt this project from the selection process, <br />FINANCIAL IMPACT: The anticipated cost of the survey is $7,200, ERCD had earlier <br />estimated the cost would be less than $5,000 because some boundaries had already been <br />surveyed in 1999. The surveyor is required, however, to verify those previously surveyed <br />lines in order to accurately calculate the easement area, Funds for this work will come from <br />the Lands Legacy Opportunities Fund. <br />RECOMMENDATIONS: The Manager recommends that the Board authorize ERCD to work <br />with the Purchasing Director in executing a contract with ENT Land Surveys, Inc. for a survey <br />of the Keith property for use by Orange County in acquiring a conservation easement; and <br />exempt this project from the requirements of GS 143, Article 3D as it respects the selection <br />of surveyors. <br />
