Lands to which this Ordinance Applies. <br />This Ordinance shall apply to all SFHAs within the jurisdiction of Orange County, including <br />Extra-Territorial Jurisdictions (ET.~, if applicable, and within the jurisdiction of any other Orange <br />County whose governing body agrees, by resolution, to such applicability. <br />Wording now in <br />(Ord. of 8-28-1995, § .3.1, eff. 8-28-1995) line with N.C. <br />Flood Act of <br />Sec. 42-38. Basis for establishing the Special Flood Hazard Areas, 2000 (5) <br />The areas-ef SFHA are those identified by the FEMA or produced under the Cooperating <br />Technical State agreement beri+~een the State of North Carolina and FEMA in its FHBM or_Flood <br />Insurance Study_(FIS) and its accontpar~ying,flood maps such as the FIRM(S) and/or the FBFM(s), for <br />Orange County_dated March 16, 1981, which with accompanying ===aps-ar=a-o~=~= supporting data, and <br />any future map update or revision thereto, including Letter°s of Map Amendment or Revision, are <br />adopted by reference and declared to be a part of this Ordinance. The SFHA also include those defined (5) <br />through standard engineering analysis for private developments or by governmental agencies, but not <br />incorporated into tlae FIRM This includes, but is not limited to, detailed flood data: <br />1. Detailed flood data goner°ated as a requirement of Section 41-69 (11/Il) of7his Ordinance; <br />2. Prelitttinm~y FIRMS where more stiringent than the effective FIRM, or <br />3. Compliance <br />No structure or land shall hereafter be located, extended, converted, stt2ic4taally altered, or <br />developed, improved, or maintained in any way without full compliance with the terms of this <br />Ordinance and other applicable regulations. <br />(Ord. of 8-28-1995, § .3.4, eff. 8-28-1995) <br />Planning Board suggestion` <br />Sec. 42-40. Abrogation and greater restrictions. <br />This Ordinance is not intended to repeal, abrogate, or impair any existing easements, <br />covenants, or deed restrictions, However, where this Ordinance and iuzetker any outer Ordinance or <br />regulatia: conflict or overlap whichever imposes the more stringent restrictions shall prevail. <br />(Ord. of 8-28-1995, § 3,5, eff. 8-28-1995) <br />
