Service Sites, Attachment B3 no later than <br />November 1, 2026. <br />Upon Passing of and offering Communication <br />services to all 105 locations listed as “Final <br />Service Sites”, Attachment B3 no later than <br />November 1, 2026. <br />$200,000.00 <br />3.Replacement of Attachments A/A2 & C/C2 – Service Area Map & Construction Plan and Timeline <br />Attachment A2 (“Revised Service Area Map”) (having replaced Attachment A (“Service Area Map”)), and <br />Attachment C2 (“Revised Construction Plan and Timeline”) (having replaced Attachment C <br />(“Construction Plan and Timeline”)) shall be replaced in its entirety and in all instances by the new <br />Attachment A3 (“Final Service Area Map”), and Attachment C3 (“Final Construction Plan and Timeline”). <br />4.Addition of Attachment B3 – Final Mutually Agreed Service Sites <br />There shall be a new Attachment B3 (“Final Mutually Agreed Service Sites”) for the purposes of <br />identifying the remaining locations to be served and marked by the revised payment milestones. Within <br />the new Attachment B3 (“Final Mutually Agreed Service Sites”), there shall be two divisions of the <br />addresses identified as “Polygon 82” and “Polygon 83” which shall be based upon the polygons depicted <br />in the new Attachment A3 (“Final Service Area Map”) and correspond to the revised disbursement <br />schedule in Section 13. <br />5.Definitions <br />The definition of “Location” in Section 3 Definitions shall be replaced with the following: <br />•“Location” means the site of a potential or current Customer found in the Mutually Agreed <br />Service Sites (Attachment B), the Remaining Mutually Agreed Service Sites (Attachment B2), or <br />the Final Mutually Agreed Service Sites (Attachment B3). <br />The definition of “Placing Conduit” shall be added to Section 3 Definitions as the following: <br />•“Placing Conduit” means the all conduit have been placed in the ground, including all required <br />bores, trenching activities, and conduit placement activities. To qualify as “Placing Conduit” it <br />must have been installed in accordance with applicable engineering specifications and industry <br />standards. Furthermore, such installation must have been certified by Provider and verified by <br />County that the installed conduit is ready for subsequent fiber placement activities, subject only <br />to routine testing, inspections, permitting closeout, or other activities that do not require <br />additional conduit construction. <br />6.Network Description <br />The Parties hereby agree to amend Section 6 of the ND Agreement to include 48 fiber distribution hubs, <br />750 miles of fiber, and no less than 5,964 locations along the route (the “Mutually Agreed Services <br />Sites”). <br />3 <br />Docusign Envelope ID: C95BA5CE-286E-8718-83D8-162116199294
