J10327.000-0032-000 r <br /> and/or uses other labor services,an Alternate Employer Endorsement naming the Trade Contractor is to be included as part of the policy <br /> and evidenced with the Certificate of Insurance,or Trade Contractor must provide Construction Manager with a Minimum Premium <br /> Policy(a.k.a."If Any"policy)from the employee leasing firm.Trade Contractor agrees to comply with any requests by the Construction <br /> Manager to verify coverage is being provided for leased or temporary employces.If Trade Contractor is leasing labor to Construction <br /> Manager,then Trade Contractor shall attach the alternate employer endorsement to its workers'compensation policy,and shall schedule <br /> the Construction Manager and the Agreement on the form. <br /> • If the work will involve,in whole or in part,work or operations on or near navigable waters of the United States,or on a flagged vessel, <br /> then Trade Contractor shall obtain coverage pursuant to the Jones Act and/or the Longshoremen's and Harbor Worker's Compensation <br /> Act as applicable. <br /> • Trade Contractor warrants that it has and shall maintain WC/EL insurance to cover any compensable or other legally viable employee <br /> claim arising under the laws of the state in which the Project is located.Trade Contractor expressly agrees that it will defend,indemnify <br /> and hold Construction Manager harmless from any uninsured claims as defined herein. <br /> 2.2 Commercial General Liability:Trade Contractor shall provide Commercial General Liability insurance for Bodily Injury,Personal <br /> and Advertising Injury,and Property Damage. Coverage must be provided on the most recent edition of the ISO CG 00 01 form on an <br /> Occurrence basis. The general aggregate must apply per Project,or per Work Order as applicable. <br /> • Limits: <br /> • $1,000,000 Each Occurrence(except for Projects within the State of New York must be$2,000,000 each occurrence) <br /> • $1,000,000 Personal and Advertising Limit <br /> • $2,000,000 General Aggregate Limit,applicable Per Project(except for Projects within the State of New York must be <br /> $4,000,000 General Aggregate Limit) <br /> • $2,000,000 Products Completed Operations Aggregate Limit(except for Projects within the State of New York must be <br /> $4,000,000 Products Completed Operations Aggregate Limit) <br /> • $5,000 Medical Expense <br /> • Coverage for explosion,collapse,and underground hazards(XCU)and subsidence <br /> • Blanket Contractual Liability,with no modification to or deletion of the"insured contract"exception to the contractual liability <br /> exclusion <br /> • No exclusions for Independent Contractors or Damage to Work Performed by Trade Contractors on Your Behalf <br /> • No modification to the standard Employers Liability exclusion,which gives back coverage for an"insured contract" <br /> • Policy shall not contain any exclusions directed toward any types of projects,materials or processes involved in the Work, <br /> including,but not limited to: <br /> • Work within fifty(50)feet of any railroad property,or affecting any railroad bridge or trestle,tracks,roadbeds,tunnel, <br /> underpass or crossing. If applicable,ISO endorsement CG 24 17 shall be attached to the policy <br /> • Defense costs must be in addition to,and not deplete,policy limits; <br /> • Must not contain any exclusions or limitations of coverage because of Wrap-up exclusions or project specific exclusions. <br /> • Must not contain any exclusion for or limitation applicable to residential work,or any prior work exclusion. <br /> • Must not contain any exclusions for or limitation applicable to heights,or any similar exclusion limitation. <br /> • Must not contain any exclusions for or limitations applicable to labor law,or any similar exclusion/limitation. <br /> • Must not contain any exclusions for or limitations applicable to 3rd party over action claims,or any similar <br /> exclusion/limitation. <br /> • Must not contain any exclusions for or limitations applicable to Exterior Insulation Finish Systems,Synthetic Stucco,Direct <br /> Applied Finish Systems,or any similar system. <br /> 2.3 Business Automobile Liability:Trade Contractor shall provide Business Automobile Liability insurance on the most recent ISO <br /> form for claims for damages due to bodily injury or property damage arising out of the ownership,maintenance,or use of any land motor vehicle <br /> (including trailer or semitrailer)used in connection with the Work,including,without limitation,loading and unloading. <br /> • Limits: <br /> -37- <br />
