<br /> attached Trade Contractor Insurance Requirements Exhibit.
<br /> EXHIBIT A—DEFINITIONS
<br /> hi the event of a conflict between any of the definitions in this Exhibit A and any of the definitions contained within the Contract Documents,the
<br /> definitions in the Contract Documents shall control:
<br /> "Applicable Laws" Shall mean all applicable laws,statutes,ordinances,codes,rules and regulations,and
<br /> lawful orders of public authorities applicable to the Trade Contractor's performance
<br /> under this Agreement and other programs as may be required by governmental and
<br /> quasi-governmental authorities including but not limited to OSHA standards as well
<br /> the Construction Manager's site-specific Accident Prevention Plan;all applicable Fair
<br /> Employment Practices,provisions and regulations of Federal,State or other
<br /> Governmental authority having jurisdiction including the provisions of Executive Order
<br /> No. 11246,and Title VII of the Civil Rights Act of 1964,including amendments or
<br /> revisions thereof,relating to nondiscrimination in employment,and any affirmative
<br /> action provisions(including small business,minority-owned business,locally-owned
<br /> business or similar requirements and/or local hiring requirements)contained in the
<br /> Contract Documents or required by applicable law and all wage and workplace
<br /> standards and all prevailing wage requirements;all applicable federal,state,municipal
<br /> and local employment and immigration laws including all rules,regulations and
<br /> procedures required to ensure full compliance with all such laws;
<br /> "Approval" Shall mean where required for an item,shall be obtained from the Architect or the
<br /> Owner through the Construction Manager in writing;
<br /> "As hidicated" Shall mean a reference to example details,notes,or schedules on the drawings,other
<br /> paragraphs or schedules in the Specifications,and similar requirements in the Contract
<br /> Documents to define the Work and is not meant to limit the scope. Where terms such
<br /> as"Shown","Noted","Scheduled",and"Specified"are used instead of"Indicated",
<br /> it is for purpose of helping the reader accomplish the reference,and no limitation of
<br /> location is intended except as specifically noted;
<br /> "At no additional cost" The term"at no additional cost"shall mean at no additional cost to the Owner,the
<br /> Architect,or the Construction Manager,and that all such costs are the Trade
<br /> Contractor's responsibility;
<br /> "Benchmarks" Shall mean portions of the actual Work in place used to establish a standard of
<br /> measurement,evaluation or quality and in compliance with the Construction
<br /> Manager's Quality Plan included within the Project Manual;
<br /> "Construction Manager" Shall have the meaning given to such term in the Preamble of this Agreement;
<br /> "Construction Manager's Schedule" The schedule shall contain detail appropriate for the Project,including(1)the date of
<br /> commencement of the Work,interim schedule milestone dates,and the date of
<br /> Substantial Completion;(2)an apportionment of the Work by construction activity;
<br /> and(3)the time required for completion of each portion of the Work;
<br /> "Contract Sum" The Contract Sum is the total amount payable by the Construction Manager to the
<br /> Trade Contractor for timely and proper performance of the Work under the Contract
<br /> Documents;
<br /> "Contract Time" Unless otherwise provided,the Contract Time is the period of time,including
<br /> authorized adjustments,allotted in the Contract Documents for the Trade Contractor
<br /> to complete the Work;
<br /> "Drawings" Shall mean drawings,diagrams,schedules and other data categorized as the following:
<br /> (i) "Design Drawing"means drawings,diagrams,schedules and other data
<br /> specifically prepared by a discipline of the design team,stamped and sealed by the
<br /> Designer of Record,as representing the design intent(ii)"Coordination Drawing"
<br /> means drawings showing work with horizontal and vertical dimensions required to
<br /> avoid interference with structural,framing MEP rough-ins,fire protection,elevators,
<br /> adjacent trade contactors'scope of work,and other thru floor and wall penetrations;
