<br /> • The policy must contain a Riggers Liability endorsement with minimum limits equal to the value of the most expensive hoist intended in the
<br /> Trade Contractor's Scope of Work and provide coverage for loss or damage to all property,including not only property in operator's
<br /> care,custody and control but also consequential damage to all other property arising from all Crane and/or Rigging operations.
<br /> • The insurance coverages will be the broadest form available including,Boom Overload and Collapse,Over-the Road Liability,Debris
<br /> Removal,Preservation of Property and if applicable,Property in Transit. The policy will name the Construction Manager,Owner and
<br /> other entities as may be reasonably requested as Additional Insureds and Loss Payees.
<br /> • All damages to the crane are the sole responsibility of the Trade Contractor and the Trade Contractor waives and shall cause all
<br /> applicable insurance carriers providing physical damage insurance on the Crane to also waive all right of recovery against the Construction
<br /> Manager,Owner,parties required of the Prime Contract and all other parties with interest in the Project for all damages to the crane.
<br /> 2.9 Cyber Liability Insurance: If the Trade Contractor's scope of work for the Agreement involves working on Building Information '
<br /> Systems,Security/Access Control Systems or Tel/Data Systems,handling personally identifiable information of Construction Manager ori
<br /> Owner,the Trade Contractor shall provide Cyber Liability Insurance.
<br /> • Limits:
<br /> • $2,000,000 Each Occurrence
<br /> • $2,000,000 Aggregate
<br /> • Coverage shall be sufficiently broad to respond to the duties and obligations as is undertaken by Vendor in this agreement and shall
<br /> include,but not be limited to,claims involving:infringement of intellectual property(including but not limited to infringement of copyright,
<br /> trademark,and trade dress),invasion of privacy violations,information theft,damage to or destruction of electronic information,release of
<br /> private information,alteration of electronic information,extortion,and network security.The policy shall provide coverage for breach
<br /> response costs as well as regulatory fines and penalties as well as credit monitoring expenses with limits sufficient to respond to these
<br /> obligations.
<br /> 2.10 Aviation Liability Insurance: In the event any fixed aircraft,rotary aircraft,or Unmanned Aerial Vehicles("drones')are used in the
<br /> execution of the Work,whether owned,leased,or borrowed,Aviation Insurance is required.
<br /> • Limits:
<br /> • $5,000,000 Each Occurrence for drones
<br /> • $25,000,000 Each Occurrence for helicopters,plus Aircraft Hull Insurance for the full replacement value of the aircraft
<br /> • Insurance shall provide coverage for all claims,suits,obligations,liabilities and damages(including attorneys'fees)arising out of actual or
<br /> alleged Bodily hijury,Property Damage,and/or Personal and Advertising Injury
<br /> 2.11 Other Coverages: To the extent that the Trade Contractor's work requires any additional insurance coverage,including but not
<br /> limited to Marine Coverage,Construction Manager reserves the right to require the Trade Contractor to maintain such additional coverage as
<br /> applicable. To the extent that the Prime Contract requires additional insurance or coverage with higher limits than required in this Exhibit B,then
<br /> Trade Contractor shall provide additional coverage and/or higher limits.
<br /> 3. GENERAL INSURANCE REQUIREMENTS
<br /> 3.1 Additional Insureds: For purposes of this Article"Additional Insureds"shall mean(1)the Construction Manager(and its partners or
<br /> members if Construction Manager is a joint venture or LLC),(2)Owner,(3)both Owner and Construction Manager's officers,directors and
<br /> employees,(4)any person or entity requested by Construction Manager or Owner,and(5)any other person or entity required to be added as
<br /> an additional insured by the Contract Documents or you have agreed to in writing. The Additional Insured parties shall be granted such status on
<br /> the Trade Contractor's Commercial General Liability,Commercial Automobile Liability,Umbrella/Excess Liability,and Pollution policies. Each
<br /> policy shall state that the insurance provided to the Additional Insured is Primary and Non-Contributory to any other insurance(including
<br /> primary,excess,self-insurance,or on any other basis)available to the Additional Insured. The policies provided under this Exhibit shall not
<br /> eliminate or restrict coverage for claims or suits between Named Insureds and Additional Insureds. To the fullest extent permitted by law,the
