Ordinance Hill), 919-969-5061 <br /> PURPOSE: To review and make a recommendation to the Board of County Commissioners <br /> (BOCC) on an applicant-initiated rezoning application to rezone +/-15.5 acres (PIN: 9787-00-8466) <br /> located at 1651 Old Lystra Road, Chapel Hill. The parcel is located in the Town of Chapel Hill's <br /> "Transition Area", as designated in the Orange County— Chapel Hill —Carrboro Joint Planning Land <br /> Use Plan (JPLUP). The proposed rezoning, which follows the Town's Land Use Management <br /> Ordinance and the zoning districts defined therein, is: <br /> FROM: Residential-Low Density-1 (R-LD1) <br /> TO: Residential-4—Conditional Zoning District (R-4-CZD) <br /> BACKGROUND: The Town of Chapel Hill has received an application to rezone a 15.5 acre <br /> parcel that is split between the Town's ETJ (Extraterritorial Jurisdiction) and "Transition Area" <br /> (see Attachment 1 and https://www.chapelhillnc.gov/Projects/Holy-Trinity-Anglican-Church; the <br /> website includes links to files/information that have not been included as attachments to this <br /> agenda item). <br /> The JPLUP defines "Transition Areas" as being "located adjacent to the urban areas of Chapel <br /> Hill and Carrboro. They are in the process of changing from rural to urban uses or are already <br /> urban in use; are developed at or suitable for urban-type densities; and are now provided or are <br /> projected to be provided with urban services." (page 71 of plan document). <br /> Applications for rezonings in the Transition Area are subject to Chapel Hill's zoning regulations <br /> but require review and approval from both the Chapel Hill Town Council and the Orange County <br /> Board of Commissioners, as outlined in Section 2.1.0 of the Joint Planning Agreement <br /> (Appendix A of the JPLUP linked above). The Orange County Planning Board makes a <br /> recommendation to the BOCC as part of the normal County review process for rezonings. A <br /> joint public hearing of the Chapel Hill Town Council and BOCC will be scheduled soon. <br /> The proposed development consists of a "Place of Worship" and up to 10 dwelling units. The <br /> Town's staff report is included in Attachment 2; the Town's proposed Ordinance is included as <br /> an attachment to the staff report and includes numerous proposed conditions. <br />
