<br />Like Software Policy and Termination of Licenses Page 1 <br />12-Apr-2026 <br /> ONC01-CO3 Attachment A <br />Octave Products <br />“Like Software” Maintenance Support Policy and <br />Customer Termination of Certain “Like Software” Licenses Form <br /> <br />Pursuant to Octave policy, if Customer has a software maintenance support on one software license, the Customer is <br />required to have a software maintenance support covering all Like Software licenses. “Like Software” shall mean all <br />software of the same title, same product content, modules of that title or content, prerequisite software, Upgrades, or <br />successor branding. By way of example and not limitation, if the Customer has twenty (20) Octave OnCall Dispatch <br />Advantage perpetual licenses and desires to enter into a Software Maintenance Support Agreement for Octave OnCall <br />Dispatch Advantage licenses, the Customer will be required to have all twenty (20) Octave OnCall Dispatch perpetual <br />licenses covered under software maintenance support regardless of the Customer’s use of all twenty (20) licenses. In order <br />to obtain software maintenance support on less than the full number of Like Software licenses, the Customer may terminate <br />its rights in those particular Like Software licenses for which it chooses not to obtain software maintenance support. <br /> <br />By its signature hereto of a duly authorized representative of Customer and submission of the same to the Octave <br />Maintenance Contracts Department, Customer hereby relinquishes, surrenders, terminates and forever disclaims its right <br />to use or allow the use in any manner of the Like Software licenses specifically listed in Exhibit A attached hereto and <br />incorporated by reference. Remaining Like Software licenses not affected by this termination are specifically listed in <br />Exhibit B attached hereto and incorporated by reference. Customer represents and warrants that it has listed all remaining <br />Like Software licenses in Exhibit B in the possession of or for use by Customer and that it has no other Like Software titles <br />or copies, licensed or not, in its possession or for its use. <br /> <br />Maintenance fees related to terminated software licenses hereunder will only be removed from an existing Software <br />Maintenance Support Agreement at agreement renewal. Customer must destroy all licenses that have been terminated. <br />Octave shall not reinstate any licenses that have been terminated by the Customer. The Customer must purchase a new <br />license for the desired software product if it has need of the same in the future.
