36 <br /> Orange County, NC I CONSTRUCTION MANAGER AT RISK CONTRACT I CONFIDENTIAL DRAFT <br /> EXHIBIT D - GMP AMENDMENT TEMPLATE <br /> GMP Amendment No. <br /> This GMP Amendment("Amendment") is entered into as of the day of 20 , by and <br /> between the Orange County, North Carolina ("Owner") and ("CMAR"), and <br /> amends the Construction Manager at Risk Contract dated (the "Contract"). <br /> RECITALS <br /> WHEREAS, the CMAR has submitted a Guaranteed Maximum Price for the Work as described herein; and <br /> WHEREAS, the Board has approved the GMP by resolution dated ; and <br /> WHEREAS, the parties desire to formalize the GMP and authorize commencement of Phase 2 Construction <br /> Services; <br /> NOW, THEREFORE, the parties agree as follows: <br /> 1. Guaranteed Maximum Price <br /> The Guaranteed Maximum Price for the entire Work is established as follows: <br /> Cost of the Work (Subcontracts + Direct Costs) $ <br /> CMAR General Conditions Allowance (Not to Exceed) $ <br /> CMAR-GMP Contingency(Not to Exceed 4.0%) $ <br /> CMAR Fee (_% — Fixed Lump Sum) $ <br /> Pre-Construction Fee (previously earned, included for record) $ <br /> TOTAL GUARANTEED MAXIMUM PRICE $ <br /> 2. Construction Schedule <br /> Phase 2 Notice to Proceed Date: <br /> Required Substantial Completion Date: <br /> Required Final Completion Date: <br /> Liquidated Damages Rate: $ per calendar day after required Substantial Completion date <br /> 3. Performance and Payment Bonds <br /> The CMAR shall deliver Performance and Payment Bonds each in the amount of$ (100% <br /> of GMP)within ten (10) days of executing this Amendment. <br /> 4.
