I have also reviewed a draft of the document <br /> prepared by the -Planning Department staff which sets forth the <br /> issues, public concerns and County response/actions to the <br /> comments made at the July 10, 2002 Planning Board meeting. I am <br /> writing separately to amplify and in some instances clarify the <br /> County response/actions contained in the Planning Department <br /> staff document. <br /> My July 12, 2002 analysis of the legal effect of Board of <br /> Commissioner approval of the Tuscany Ridge Subdivision did not <br /> include the fact that had an error occurred in the process <br /> followed by the County in approving the preliminary plan for <br /> Tuscany Ridge, there would be a basis for reconsideration. <br /> However, it is my opinion, based or. my review of the transcribed <br /> minutes of the July 10, 2002 Planning Board meeting and my <br /> review otherwise of the process followed by Orange County in the <br /> Board' s consideration of the preliminary plan for the Tuscany <br />
