5 Draft <br /> 1 provided via four ingress-egress points along New Jericho Road, similar to the 2015 master <br /> 2 plan and approval. The submitted application and evidence was reviewed by staff and was <br /> 3 determined to be complete per the requirements of Orange County UDO Sections 2.5,2.7, and <br /> 4 5.8.4.The applicant also submitted material evidence to support Orange County UDO submittal <br /> 5 requirements and use standards. Staff finds that the special use proposed will maintain or <br /> 6 promote the public health, safety, and general welfare if located where proposed and <br /> 7 developed and operated according to the site plan. Based on the materials provided, staff finds <br /> 8 no potential injury to the value of property. As documented in the staff report, staff finds the <br /> 9 use will be in harmony with the area in which it is to be located, and the use is compliant with <br /> 10 the plan for the physical development of the county. Based on Section 2.7.3 of the UDO, the <br /> 11 BOA may impose such reasonable conditions upon approval of the SUP. Here we have the <br /> 12 conditions which have been submitted by staff. Conditions 1 through 11 include the conditions <br /> 13 contained in the existing approved special-use permit from 2015, with minor edits for <br /> 14 consistency and compliance with existing UDO standards. Conditions 13 through 17 have been <br /> 15 submitted by the applicant for your review tonight. So, when this process started and the applicant came in to do the revision, it was, with <br /> 26 staff's review, it was brought to our attention that the SUP that was approved in 2015 had <br /> 27 actually not been recorded.So,we did work with legal staff and our applicant so that we drafted <br /> 28 the SUP, and it had been recorded earlier this year. <br /> 29 <br /> 30 Leon Meyers: So that's why we have a 2015 SUP with a 2025 recording date. <br /> 31 <br /> 32 Ashley Moncado: It's the SUP, yes, had not been drafted in 2015 and not been recorded, but we did go back <br /> 33 through all the board materials at that time. The 2015 SUP was presented to the BOCC. It <br /> 34 would have been a quarterly public hearing.
