Article 2: Procedures <br /> Section 2.15: 17FMajor Subdivisions <br /> County. <br /> (B) Application Requirements <br /> (1) The subdivider shall submit an application in accordance with this Ordinance, <br /> including <br /> (a) The requirements of Section 2.2; <br /> (b) The requirements of Section 7.13, <br /> (c) One electronic copy of the Final Plat; <br /> (d) The requirements of Article 6, including, but not limited to, a Landscaping <br /> Plan and Stormwater Management Plan; and <br /> (e) Required ancillary documents prepared in accordance with Article 7 of <br /> this Ordinance. <br /> (2) Any necessary Performance Guarantees, as determined by Orange County. <br /> (C) Review and Approval Procedures <br /> (1) The Planning Director shall determine if the application is complete, the Planning <br /> Director shall approve or deny the final plat, with written explanation regarding <br /> any reasons that are the basis of a denial. <br /> (a) Final plats that include elements requiring Board of County <br /> Commissioner approval shall be referred to that Board with a Planning <br /> Director recommendation of action. <br /> (D) Actions Subsequent to Approval <br /> (1) The applicant shall submit a mylar original of the Final Plat to the Planning <br /> Director for signature within one year of Final Plat approval. <br /> (a) The approved plat and any associated documents must be recorded <br /> within 90 calendar days after the Planning Director's signature, or the <br /> approval shall be determined to be void and all materials will be required <br /> to be resubmitted. <br /> (b) The Planning Director may extend the recordation deadline by an <br /> additional 90 calendar days from the original date of expiration upon a <br /> request by the applicant that they are unable to meet the deadline due to <br /> demonstrated causes such as weather conditions, financial impacts, or <br /> permitting delays with external agencies, and provide evidence that such <br /> causes are beyond the applicant's control. <br /> (2) If the applicant proposes to amend the approved Preliminary Plat, the Planning <br /> Director shall determine if the amendment is minor, as defined herein, and <br /> requires only a Final Plat revision, or is a major amendment and requires a new <br /> preliminary plat application.22 <br /> (a) A change shall be considered a minor change if it does not involve any of <br /> the following: <br /> (i) Any substantive change in a condition of approval; <br /> (ii) An increase in the number of building lots proposed; <br /> (iii) Any 5% change to the location of or any decrease in the amount <br /> of open space, buffers, or area reserved for recreation use; <br /> (iv) Any change in pedestrian and/or vehicular access networks that <br /> zz It seems nearly impossible to qualify for a "minor change."
