Article 2: Procedures <br /> Section 2.14: Minor Subdivisions <br /> 2.14.2 Requlated Review <br /> (A) Preliminary Plat <br /> (1) Application Requirements <br /> (a) Subdivisions qualifying for Regulated Review under Section 7.2.2 of this <br /> Ordinance, as determined by the Planning Director, shall require <br /> (i) Applications submitted in accordance with this Ordinance, <br /> including Sections 2.2 and 7.13; and <br /> (ii) An electronic copy of the Preliminary Plat. <br /> (2) Preliminary Plat Review and Action <br /> (a) The DAC shall review the plat and associated materials for compliance <br /> with this Ordinance in addition to applicable local and State regulations. <br /> (b) A Neighborhood Information Meeting (NIM) NIM report and recording <br /> shall be provided to the Planning Director, as required by Section <br /> 2.14.2(B). <br /> (c) Upon receipt of the comments and recommendations from reviewers, the <br /> T Planning Director shall take action on the Preliminary Plat to approve or <br /> deny it, with written notification regarding any reasons that are the basis <br /> of a denial. <br /> (i) The preliminary plat shall be considered denied unless the <br /> applicant responds with revisions within 60 calendar days of <br /> receiving comment. A new application is needed for any further <br /> land use changes to the subject property. <br /> (3) Neighborhood Information Meeting for Minor Subdivisions <br /> (a) A minor subdivision application shall require a Neighborhood Information <br /> Meeting (NIM) if it proposes more than five lots, excluding open space. <br /> (b) As a component of a Preliminary Plat application, the applicant shall <br /> schedule a NIM and shall obtain property owner mailing address <br /> information from Orange County. <br /> (c) The applicant shall mail notices of the meeting to each property owner <br /> within one thousand feet of the property proposed to be subdivided. <br /> Notices of the NIM shall be mailed by first class mail at least 14 calendar <br /> days prior to the date of the meeting. <br /> (d) The applicant shall place a sign on the affected property, including the <br /> date, time, and location of the NIM, and the Planning Department <br /> telephone number. The sign shall be posted on the affected property at <br /> least 14 calendar days prior to the NIM. The NIM shall be held a prior to <br /> Final Plat Application submittal. <br /> (e) The purpose of the NIM is for the applicant to present the proposed <br /> Preliminary Plat to persons in attendance, to answer questions about the <br /> proposed subdivision, and to receive comments from neighboring <br /> Property owners for the purpose of improving the proposed subdivision <br /> design. <br /> (f) The applicant shall submit a recording, audio or audio/video, along with a <br /> written report of the NIM to the Planning Department. <br /> (i) The written report of the meeting shall include a list of those <br /> persons and organizations contacted about the meeting and the <br /> manner and date of contact; the time, date, and location of the <br /> meeting; a roster of the persons in attendance at the meeting; a <br /> summary of issues discussed at the meeting; and a description <br /> Orange County, North Carolina—Unified Development Ordinance Page 2-42 <br />
