Article 10: Definitions <br /> Section 10.1: Definitions <br /> d-)e)The division of a tract into parcels in accordance with the terms of a probated will or in <br /> accordance with intestate succession under Chapter 29 of the North Carolina General Statutes. <br /> Subdivision, Expedited Minor <br /> The subdivision of a tract or parcel of land in single ownership that fulfills all of the following criteria: <br /> a) The tract or parcel to be divided is not exempt under the provisions of the Ordinance; <br /> b) No part of the tract or parcel to be divided has been divided via the expedited minor subdivision <br /> process within the past 10 years prior to plat recordation; <br /> c) The entire area of the tract or parcel to be divided is greater than two acres; <br /> d) The subdivision creates no more than three lots; and <br /> e) All resultant lots comply with the following: <br /> 1. Applicable lot dimension and size requirements of this Ordinance; <br /> 2. Applicable land use requirements of this Ordinance; <br /> 3. See definition of"substantial improvement." Substantial damage <br /> also means flood-related damage sustained by a structure on two separate occasions during a ten-year <br /> period for which the cost of repairs at the time of each such flood event, on the average, equals or <br /> exceeds 25% of the market value of the structure before the damage occurred. <br /> Substantial improvement <br /> Any combination of repairs, reconstruction, rehabilitation, addition, or other improvement of a structure, <br /> taking place during any one year period whereby the cost of which equals or exceeds 50% of the market <br /> value of the structure before the start of construction of the improvement. This term includes structures, <br /> which have incurred substantial damage, regardless of the actual repair work performed. <br /> The term does not, however, include either: <br /> a) Any correction of existing violations of State or Orange County health, sanitary, or safety code <br /> specifications which have been identified by the Orange County code enforcement official and <br /> which are the minimum necessary to assure safe living conditions, or <br /> b) Any alteration of a historic structure provided that the alteration will not preclude the structure's <br /> continued designation as a historic structure and the alteration is approved by a variance issued <br /> pursuant to this Ordinance. <br /> Support System <br /> Orange County, North Carolina-Unified Development Ordinance Page 10-57 <br />
