2 <br /> In addition, Orange County wishes to design and construct a regional stormwater management <br /> retrofit project at Efland-Cheeks Park in order to comply with current Falls Lake Rules' Existing <br /> Development requirements. <br /> Orange County is a member of the Upper Neuse River Basin Association (UNRBA), a regional <br /> partnership consisting of local governments, regulators, and environmental advocacy groups <br /> created in 1996 to help improve and preserve the water quality of the Upper Neuse River Basin. <br /> In 2021, the Board of the UNRBA voted unanimously to move forward with an Interim Alternative <br /> Implementation Approach (IAIA) to invest a combined $1.5 million each year in water quality <br /> projects and activities to reduce nutrient contribution from urbanized land located in the 770- <br /> square-mile Falls Lake watershed. Orange County has committed to investing funds each fiscal <br /> year to design and construct stormwater management retrofits to existing development within the <br /> watershed in conformance with the IAIA requirements and in good standing with the UNRBA. <br /> In order to move forward with current Orange County and OCS initiatives as described above, <br /> Orange County must first complete a topographic survey across approximately 19 acres of the <br /> overall 27-acre project site, and OCS must first complete a boundary survey across the overall <br /> 27-acre project site. Orange County and OCS mutually wish to serve these needs with a single <br /> professional surveying contract, proportionately supported via a cost-share MOU (Attachment 1). <br /> The MOU will reduce the overall surveying costs for both parties. <br /> Orange County has informally solicited a professional surveying services proposal from Riley <br /> Surveying, P.A., in accordance with North Carolina General Statutes 143-64.31 and 143-64.32, <br /> which exempts the procurement of architectural, engineering, and surveying services using a <br /> qualifications-based basis if the estimated fee is less than $50,000. <br /> The total cost of the combined professional surveying work (i.e., boundary survey and topographic <br /> survey) is $48,500. Per the MOU, OCS will cover 55% ($26,675) of the total cost for the combined <br /> professional survey work and Orange County will cover 45% ($21,825) of the total cost for the <br /> combined professional surveying work. See Attachment 1. <br /> FINANCIAL IMPACT: The negotiated Orange County share of the professional surveying <br /> services of $21,825 will not exceed the currently appropriated IAIA project budget of $264,426. <br /> Any subsequently approved MOUs, agreements, and/or related amendments will not exceed the <br /> appropriated project budget. <br /> ALIGNMENT WITH STRATEGIC PLAN: This item supports: <br /> • GOAL 1: ENVIRONMENTAL PROTECTION AND CLIMATE ACTION <br /> OBJECTIVE 6. Protect water supply/watersheds. <br /> RECOMMENDATION(S): The Manager recommends that the Board approve and authorize the <br /> Board Chair to execute the Memorandum of Understanding between Orange County and Orange <br /> County Schools (Attachment 1) on behalf of the Board <br />
