STATE OF NORTH CAROLINA <br />COUNTY OF ORANGE <br />AMENDMENT TO LEASE <br />THIS AMENDMENT TO LEASE, made and entered into this the 20th day of May 2003, by and <br />between Carr Mill Mall Limited Partnership, a North Carolina Domestic I:imited partnership, hereinafter <br />referred to as "LANDLORD", and, Orange County, a politic subdivision of the State of North Carolina, <br />hereinafter referred to as "TENANT"; <br />WITNESSETH: <br />THAT, WHEREAS, the parties hereinto entered into a Lease Agreement dated October 4, 1985 <br />and renewed on March 3, 1991, November 2, 1993, May 14, 1996 and Mary 6, 1998, (the "Lease"), <br />containing 5580 square feet of leasable area, in the Carr Mill Mall, and identified as space # D-15. <br />WHEREAS, the parties hereto have mutually agreed as herein set forth; <br />NOW, THEREFORE, in consideration of the sum often dollars ($10.00) in hand, paid by each of <br />the parties hereto, and for other good and valuable consideration, the receipt and adequacy of is hereby <br />mutually acknowledge, the parties hereby agree as follows. <br />1. The Lease term is hereby renewed for a period commencing on July 1, 2003 and continuing <br />through June 30, 2008. <br />2. Section 2 (a) of the Lease will be modified as follows: During the term of this renewal period, <br />Tenant shall pay to Landlord rent in the amount of $96,363.48 per year, in monthly installments of <br />$8,030.29. Payable in advance, on the first of each month. <br />3. Sections 2 (b), (c), (d) and (e) are deleted. <br />4. Tenant accepts premises "as is". <br />5. During this renewal, all other terms and conditions of the lease will remain the same. <br />Except as expressly modified herein, all of the terms, covenants, and conditions of the lease are hereby <br />ratified and confirmed to be in full force and effect. <br />
