CONSTRUCTION CONTRACT <br />This Construction Contract (the "Contract") is made as of November 20th, 2024 (the "Effective <br />Date") by and between Weaver Community Housing Association hereafter referred to as “Client” <br />and Zortacular LLC of 1574#A Major Hill Road, Snow Camp, North Carolina 27349 hereafter <br />referred to as “Contractor”. Contractor desires to provide Construction services to Client and <br />Client desires to obtain such services from Contractor. THEREFORE, in consideration of the <br />mutual promises set forth below, the parties agree as follows: <br />1.DESCRIPTION OF SERVICES. Replacement of 55 windows at 701, 703, and 705 <br />North Greensboro Carrboro with Wincore 500 series windows of the same style and <br />dimensions as currently installed, black inside and out. <br />2.SCOPE OF WORK. This is a turnkey job - all rot will be repaired, and all windows will <br />be properly trimmed out inside and out and all debris removed. Windows apertures will <br />be properly sealed with foam as necessary. <br />3. <br />4.COMPLIANCE WITH LAWS. Contractor shall provide the Services in a workmanlike <br />manner. <br />5.WORK SITE. Client warrants that Client has a material interest in the property herein <br />described as of the writing of this contract and is authorized to enter into this contract. <br />Client shall provide an easily accessible building site, which meets all zoning <br />requirements for the structure. Client further warrants there are no subsurface utilities in <br />the areas to be excavated. <br />6.MATERIALS AND/OR LABOR PROVIDED: These are Wincore series 400 new <br />construction windows with flanges. They are low E with argon gas. These are vinyl <br />windows with outside wooden trim wrapped in a painted aluminum to achieve the black <br />color required. This exterior cladding is an industry standard method for achieving the <br />black outside trim you desire. The sliders will have full screens and both sides will open. <br />7.WARRA NTY: Installation is warranted for 5 years. The windows themselves have a <br />limited lifetime warranty. That warranty is attached to the email along with this <br />document. <br />8.PAYME NT. Total job cost is $$61,352. Client shall pay $42000 upfront, $7000 during <br />the installation process, and the rest upon final inspection. <br />9.TERM. Subcontractor will remain on job to completion and installation should take 2 <br />weeks. <br />10.CHANGE ORDERS.
