<br /> <br />EXHIBIT D <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />Prepared by and after recording return to: Margaret McConnell, Orange County Attorney’s Office, P.O. <br />Box 8181, Hillsborough, NC 27278 <br /> <br /> <br />DECLARATION OF RESTRICTIVE COVENANTS <br /> <br />THIS DECLARATION OF RESTRICTIVE COVENANTS (“Declaration”), dated <br />________, 2025, by Habitat for Humanity, Orange County, N.C., Inc., a North Carolina Non <br />Profit Corporation, for itself and its successors and assigns (“Owner” or “Habitat for Humanity of <br />Orange County”), is given as a condition precedent to the award of Orange County Capital <br />Investment Plan funds. <br /> <br /> <br />RECITALS: <br /> <br /> <br />WHEREAS, Orange County has designated up to Eight Hundred Thousand Dollars <br />($800,000) in FY 2023-24 Capital Investment Plan Affordable Housing Program funds to assist <br />with site infrastructure improvements contributing to the development of seventy-five (75) new <br />homes in Orange County, of which sixty (60) will be affordable homes developed and sold by <br />Habitat for Humanity of Orange County, to homebuyers earning between thirty percent (30%) to <br />eighty percent (80%) of Area Median Income (AMI); and <br /> <br />WHEREAS, the Owner intends to develop the Project, Auman Village at Meadowlands, <br />located in Hillsborough, North Carolina (hereinafter referred to as “the Project”) as a <br />homeownership community for low-income families earning between thirty percent (30%) and <br />eighty percent (80%) of the Area Median Income. The Project dwelling units will be located on <br />the property more particularly described in Exhibit A attached hereto and made a part of this <br />Agreement (hereinafter referred to as “the Property”); and <br /> <br /> WHEREAS, the Owner agrees to utilize FY 2023-24 Capital Investment Plan Affordable <br />Housing Program funds provided by Orange County solely for the purpose of developing the <br />Property as described in its FY 2023-24 Capital Investment Plan Program Funding Application <br />Docusign Envelope ID: 4B02F05F-1410-4DCD-BCEE-8DD7A7B20DAF
