DRAFT
Taylor Perschau: We would have a zoning atlas that is inaccurate. Currently there is an error in the zoning
atlas. So, if it wasn't adopted the error would remain and the zoning atlas would be
inconsistent with on the ground ridge line.

Charity Kirk: Yeah.

Taylor Perschau: So, it affects how planning staff reviews the impervious surface for this particular property.

Charity Kirk: Right.

Taylor Perschau: And part of why this is coming about now is the property is, there are three separate
applications for subdivisions that have been applied from an original parent tract. So,
they're in the process and they're trying to figure out where houses can be sited and what
their impervious surface constraints are.

Charity Kirk: Why would we want to say no?

Taylor Perschau: I don't have a good reason.

Charity Kirk: Okay, thank you. That's it.

Taylor Perschau: Yes.

Statler Gilfillen: If I am understanding what you are saying, this is a procedural issue where the original
way it was laid out is no longer in consistency or corrected to the current standards and
that you are asking us basically to bring this up to the current standards.

Taylor Perschau: Yes, the request is to get mapping to be accurate with the topography found on site, yes.

Chris Johnston: You good Charity?

Charity Kirk: Yes.

Cy Stober: And for what's it worth to play this out in the regulatory framework. This is different from
most other zoning cases in that because the EMC has recognized the watershed
boundary and because we are a delegated program by the state and these watershed
boundaries are assigned to us by the state, the appeal would go directly to the
Environmental Management Commission. It would not go to our Board of Adjustment,
and they've already recognized this boundary, so it's a bit of cart and horse, but I do think
this is the appropriate way, and this is what the state DEQ has directed us to do. This
process and this procedure of recognizing the new surveyed ridge line boundary and
following up with our locally applied zoning even though this is zoning that reflects state
watershed protections. It is cart and horse depending on how you look at it, but this is the
path forward that the state has laid out to us.

Charity Kirk: So, it would be kind of ridiculous if we said no?

Cy Stober: You could say that.

Chris Johnston: Whitney?
