Article 2: Procedure§ <br /> Section 2.14: Minor Subdivisions <br /> (a) If the submitted plat meets the Expedited Review criteria of Article 7.2, <br /> the plat shall be approved and signed. The Planning Director shall notify <br /> the applicant of final plat approval or denial in writing.? <br /> (b) If the application is denied, the Planning Director shall provide written <br /> notification to the applicant detailing the reasons for denial as an <br /> expedited subdivision.$ <br /> 2.14.2 Regulated Review <br /> (A) Preliminary Plat <br /> (1) Application Requirements <br /> (a) Subdivisions qualifying for Regulated Review under Section 7.2.2 of this <br /> Ordinance, as determined by the Planning Director, shall require <br /> (i) Applications submitted in accordance with this Ordinance, <br /> notably Sections 2.2 and 7.13; and <br /> (i i) An electronic copy of the Preliminary Plat. <br /> (2) Preliminary Plat Review and Action <br /> (a) Upon receipt of a complete Preliminary Plat application, the Planning <br /> Director shall submit copies of the application materials to the <br /> Development Advisory Committee (DAC)with ten business days for <br /> review and comment. <br /> (b) The DAC shall review the plat and associated materials for compliance <br /> with this Ordinance in addition to applicable local and State regulations. <br /> (c) A Neighborhood Information Meeting (NIM) NIM report and recording <br /> shall be provided to the Planning Director, as required by Section (B). <br /> (d) Upon receipt of the comments and recommendations from reviewers, the <br /> Planning Director shall take action on the Preliminary Plat to approve or <br /> deny it, with written notification regarding any reasons that are the basis <br /> of a denial. <br /> (i) The applicant shall respond with revisions within 60 calendar <br /> days of receiving comment or request an extension. <br /> (3) Neighborhood Information Meeting for Minor Subdivisions <br /> (a) A minor subdivision application shall require a Neighborhood Information <br /> Meeting (NIM) if it proposes more than five lots, excluding open space. <br /> (b) As a component of a Preliminary Plat application, the applicant shall <br /> schedule a NIM and shall obtain property owner mailing address <br /> information from Orange County. <br /> (c) The applicant shall mail notices of the meeting to each property owner <br /> within one thousand feet of the property proposed to be subdivided. <br /> Notices of the NIM shall be mailed by first class mail at least 14 calendar <br /> days prior to the date of the meeting. <br /> (d) The applicant shall place a sign on the affected property, including the <br /> date, time, and location of the NIM, and the Planning Department <br /> telephone number. The sign shall be posted on the affected property at <br /> least 14 calendar days prior to the NIM.
