Article 2: Procedurgg <br /> Section 2.15: 17FMajor Subdivisions <br /> and pending approval by Orange County. <br /> (3) If a Performance Guarantee is to be submitted to Orange County, it must be <br /> submitted for consideration and review accompanied by a Professional <br /> Engineering estimate or similar professional assessment of the cost and <br /> completion of the improvement for review by the Planning Director. <br /> (B) Application Requirements <br /> (1) Applications shall be submitted in accordance with this Ordinance, notably <br /> Sections 2.2 and 7.13. <br /> (2) One electronic copy of the Final Plat; <br /> (3) Required plans per Article 6, including, but not limited to, a Landscaping Plan <br /> and Stormwater Management Plan; and <br /> (4) Required auxiliary documents prepared in accordance with Article 7 of this <br /> Ordinance. <br /> (5) Any necessary Performance Guarantees, as determined by Orange County. <br /> (C) Review and Approval Procedures <br /> (1) The Planning Director shall determine if the plat and application is complete, <br /> including if there are any actions that must be taken by the Board of County <br /> Commissioners to finalize the subdivision's realization, including, but not limited <br /> to, right-of-way dedication, acceptance of public amenities, or receipt of <br /> payments in lieu of provision of recreation amenities.24 <br /> (2) Ancillary documents as required by Article 7 shall be submitted by the Planning <br /> Director to the County Attorney for legal sufficiency review. <br /> (3) Upon review and, as appropriate, approval of all submitted application materials, <br /> the Planning Director shall approve or deny the final plat, with written explanation <br /> regarding any reasons that are the basis of a denial. <br /> (a) Final plats that include elements requiring Board of County <br /> Commissioner approval shall be referred to the Board with a Planning <br /> Director recommendation of action. <br /> (D) Actions Subsequent to Approval <br /> (1) The applicant shall submit a mylar original of the Final Plat to the Planning <br /> Director for signature within one year of Final Plat approval. <br /> (a) The approved plat and any associated documents must be recorded <br /> within 90 calendar days after the Planning Director's signature, or the <br /> approval shall be determined to be void and all materials will be required <br /> to be resubmitted. <br /> (b) The Planning Director may extend the recordation deadline by one year <br /> from the original date of expiration upon a request by the applicant that <br /> they are unable to meet the deadline for reasons beyond the applicant's <br /> control. <br /> (2) If the applicant proposes to amend or modify the approved Preliminary Plat such <br /> that is not a minor change, the Planning Director shall determine if the change is <br /> minor, as defined herein, and requires only a Final Plat revision, or is major and <br /> requires a new preliminary plat application.25 <br /> 24 Clarifies that the County Commissioners do retain power of approval for any dedications associated with a <br /> subdivision, but that it is—and has been—an administrative matter. <br /> 25 It seems nearly impossible to qualify for a "minor change."
