Article 2: Procedurp <br /> Section 2.15: 17FMajor Subdivisions <br /> NO Any 5% change to the location of or any decrease in the amount <br /> of open space, buffers, or area reserved for recreation use; <br /> (iv) Any change in pedestrian and/or vehicular access networks that <br /> will alter traffic circulation patterns and/or road classifications; <br /> (v) Any change in the provision of services such as water supply <br /> and wastewater disposal; and/or <br /> NO Any substantial change in the location of utilities or other <br /> easements. <br /> (3) No building permits shall be issued to develop any lot or parcel shown on the <br /> approved Preliminary Plat until a Final Plat showing such lot or parcel is <br /> approved and recorded in compliance with this Ordinance. <br /> (4) The approval of a Preliminary Plat shall be effective for one year from the date of <br /> approval by the Planning Director. By the end of said time period the Final Plat <br /> application, or, in the case of phased projects, the Final Plat for Phase 1, must be <br /> submitted to the county for review. <br /> (a) If a phasing plan for construction of the subdivision is approved, as <br /> permitted by Subsection F, the expiration date of the subdivision's <br /> Preliminary Plat shall be governed by the time period(s) approved as part <br /> of the phasing plan and any vested rights established for a Conditional <br /> Zoning or Special Use approval. <br /> (E) Preliminary Plat Re-Approval <br /> (1) Should a Preliminary Plat expire, the Planning Director may re-approve that <br /> Preliminary Plat, or portions thereof, provided any changes to the original design <br /> are considered minor, as established in Section 2.15.1(D)(2), no more than two <br /> years from the original approval date. <br /> (2) The re-approved Preliminary Plat must be reviewed by the DAC. <br /> (3) Only one administrative re-approval may be approved for any subdivision. A re- <br /> approved Preliminary Plat expires after one year, upon which a new application <br /> for a Preliminary Plat is required.22 <br /> (F) Phasing Plan <br /> (1) A development Phasing Plan consistent with Section 7.3 may be approved as <br /> part of the Preliminary Plat (hereafter"the phasing plan"). <br /> (2) A Phasing Plan may be amended upon application by the subdivider and at the <br /> Planning Director's discretion. <br /> (a) An applicant's request to amend a Phasing Plan shall provide a rationale <br /> for why the amendment is justified and consistent with the previous <br /> approval(s)for development. <br /> 2.15.2 Final Plat <br /> (A) Development Improvement Requirements for Final PIat23 <br /> (1) Prior to approval of a Final Plat, the subdivider shall have installed associated <br /> improvements required by this Ordinance or Board approval, including but not <br /> limited to: landscaping, roads, stormwater infrastructure, lighting. <br /> (2) A subdivider may submit a Performance Guarantee to ensure installation of <br /> required elements for final platting, as provided in Section 2.27 of this Ordinance, <br /> 22 The statutory vested rights render this power moot,should anyone seek an initial extension. <br /> 21 Make it clear that all improvements must be provided or bonded prior to final plat approval, and providing <br /> references to requirements on how to do so. <br /> Orange County, North Carolina—Unified Development Ordinance Page 2-54 <br />
