Resolution Authorizing the Sale and Alan Dorman, Asset Management <br /> Upset Bid Process for 1.24 Acre Services Director, 919-245-2627 <br /> Property, PIN #9865614458 <br /> PURPOSE: To approve the sale of a County-owned 1.24 acre property, PIN #9865614458, in <br /> Hillsborough, NC, and approve a resolution authorizing the sale of the property through a <br /> negotiated offer, advertisement, and upset bid process. <br /> BACKGROUND: The County owns a 1.24 acre property, PIN #9865614458, in Hillsborough. The <br /> property is an irregular slice of land of little value to the County (Attachment 1). The Orange <br /> County Tax Administration Office has valued the land at $60,000. Dylan Grey Properties LLC, <br /> owned by Jeanette Stephens, an adjacent neighbor, approached the County with an offer to <br /> purchase for$10,000 (Attachment 2) and has submitted the proper documents and certified check <br /> for $500. <br /> When this parcel was originally established, the developer deeded the fee simple ownership to <br /> Orange County and PINs were assigned. The lot was never reserved or dedicated as a public or <br /> private right-of-way. It was common practice to create these lots as a "place holders" in the event <br /> that adjacent tracts were developed and connectivity was needed. <br /> In accordance with North Carolina General Statute 160A-269, public property may be sold through <br /> a negotiated offer, advertisement, and upset bid process. As all offers for the purchase of County <br /> property must be presented to the Board of County Commissioners for consideration, Attachment <br /> 3 is a resolution authorizing the sale of the property through an upset bid process. Should the <br /> Board approve the offer for the sale of this property in this manner, a notice of sale will immediately <br /> be placed in a local paper and on the County's Purchasing web page. The notice shall contain a <br /> general description of the property, the amount and terms of the offer, and a notice that within ten <br /> days any person may raise the bid by not less than ten percent (10%) of the first one thousand <br /> dollars, and five percent (5%) of the remainder. When a bid is raised, the bidder shall deposit <br /> with the County five percent (5%) of the increased bid, and the County shall re-advertise the offer <br /> at the increased bid amount for an additional ten days. This procedure shall be repeated until no <br /> further qualifying upset bids are received, at which time the Board may accept the offer and sell <br />
