:~a <br />Request from Orange County <br />September 2, 2005 <br />Page 2 of 2 <br />Accordingly, the Agreement provides the appropriate policy basis for an OWASA response to <br />Orange County's request. <br />The following definitions, as included in the Agreement, are pertinent. <br />Essential Public Facility <br />"A publicly-owned facility, or a facility wholly financed by Federal, State or local <br />government (or a combination thereof) that provides a service for the health, safety and <br />general welfare of County residents (for example, a school, fire station, public safety <br />substation or solid waste convenience center).." <br />OWASA Loap-Term Lrterest Area <br />"An area (as shown on the Water and Sewer Service Boundary Map, which is Appendix <br />A) within which public water and/or sewer service is not anticipated to be made, but if <br />such service are to be provided, OWASA will be the responsible utility service provider." <br />DISCUSSION <br />Staff agrees that the County's new Solid Waste Operations Center is located within OWASA's <br />Long-Term Interest Area, as delineated in the Agreement. While staff has no technical objecfion <br />to this request, as a matter of'comity extended among the governments, the OWASA Board may <br />be interested in hearing the responses from the Towns of Chapel Hill and Carrboro. We note that <br />concurrence at this time represents policy level approval only, and that subsequent decisions <br />about the routing, design, capacity, etc., of any new water/sewer lines needed to serve the <br />property will be made according to established procedures and specifications, subject, of course <br />to any other applicable requirements of the Agreement and to the "orderly provision of the water <br />and sewer service." <br />Please let us know if you have any questions or need any additional information regarding this <br />matter. <br />M.
