E. <br />DATE: September 2, 2005 <br />SUBJECT: Request from Orange County for Water and Sewer Extension to the County's new <br />Solid Waste Operations Center in the Rural Buffer <br />INTRODi7CTION <br />OWASA received a letter, dated August 10, 2005, from Mr. Moses Carey, Jr, Chair of Orange <br />County Board of Commissioners, informing us of the planned relocation of the County's Solid <br />Waste Management Department's administrative office to a new location (Attachment A), The <br />planned relocation will be to a new Solid Waste Operations Center on County property located <br />west of the active solid waste landfill along Eubanks Road (Attachment B). This property is <br />located in the Rural Buffer, outside the designated Urban Services Boundary adopted by the <br />Towns and County, and outside of OWASA's utility service area. <br />Mr. Carey's letter asks for feedback and comments from OWASA's Board of Directors about the <br />County's request to extend water and sewer service to this "essential public facility." <br />WATER AND SEWER MANAGEMENT, PLANNING AND BOUNDARY AGREEMENT <br />In December 2001 OWASA, Orange County, and the Towns of Hillsborough, Chapel Hill, and <br />Carrboro executed a Water and Sewer Mm7agement, Plannnrg and Boundary Agr°eement <br />(Attachment C). Among other things, this document establishes utility service area boundaries <br />beyond which each signatory agrees not to extend water and/or server service except in special <br />cases needed to resolve an "adverse public condition" or to serve an "essential public facility," as <br />defined in the Agreement, <br />Beyond the "Service Area" delineations, the Agreement establishes an "Interest Area" for each <br />entity, in which that entity is given the "right of first-refusal" to extend water/sewer service to <br />resolve an adverse public health condition or to serve an essential public facility, <br />
