Hadler, Beemer, Hadler&Willett, P.A. <br /> DECLARATION OF COVENANTS, CONDITIONS <br /> AND RESTRICTIONS OF <br /> DRAKEFORD LIBRARY COMPLEX CONDOMINIUM PROJECT,A CONDOMINIUM <br /> This DECLARATION, made on the date hereinafter set forth by TOWN OF <br /> CARRBORO, a North Carolina municipal corporation, hereafter referred to as the "Town" and <br /> THE COUNTY OF ORANGE, a North Carolina county, hereafter referred to as the "County", <br /> the Town and County are collectively, the "Declarant" or"Parties". <br /> WITNESSETH: <br /> WHEREAS, Declarant is the owner of certain property located on the east side of South <br /> Greensboro Street, Chapel Hill Township, Orange County,North Carolina, and more particularly <br /> described in Exhibit "A" attached hereto and incorporated herein by reference. <br /> WHEREAS, Declarant has planned, designed and constructed an approximately 124,685 <br /> gross square foot building, site improvements and associated parking including a multi-level <br /> parking deck on the Property, and now wishes to create condominium units or"units" as those <br /> are defined under the provisions the North Carolina Condominium Act and to convey the same <br /> to the Town and County subject to the covenants, conditions and restrictions herein reserved to <br /> be kept and observed and that incorporates and reflects to the extent possible the terms and <br /> conditions of the Town and County executed Development Agreement Regarding South <br /> Greensboro Street Property dated the 4th day of December, 2017, and any amendments thereto; <br /> WHEREAS, Declarant desires and intends by the filing of this Declaration, to submit the <br /> real property described in Exhibit"A" and all improvements constructed, together with all <br /> 1 <br />
