45 <br /> Section 7: "Declarant" means TOWN OF CARRBORO, a North Carolina municipal <br /> corporation, its successors and assigns, and THE COUNTY OF ORANGE, a <br /> North Carolina county, its successors and assigns. <br /> Section 8: "Declaration" means this Declaration of Covenants, Conditions and Restrictions. <br /> Section 9: "Development rights"means any right or combination of rights reserved by <br /> Declarant to add real estate to a condominium; to create units, common <br /> elements, or limited common elements within a condominium; to subdivide units <br /> or convert units into common elements; or to withdraw real estate from a <br /> condominium. <br /> Section 10: "Executive Board" means the body designated in the Declaration to act on behalf <br /> of the Association. During any period where the Town or County are the only <br /> Unit Owners, the Executive Board shall be: the Town Manager and a designee <br /> appointed by the Town Manager and employed by the Town as staff; and the <br /> County Manager, and a designee appointed by the County Manager and <br /> employed by the County as staff. <br /> Section 11: "Identifying number" means a symbol or address that identifies only one unit in <br /> a condominium. For example, Unit 1 is the County Unit and Unit 2 is the Town <br /> Unit. <br /> Section 12: "Lessee" or"Tenant' means the parry entitled to a present possession of a leased <br /> unit or portion of a leased unit whether lessee, tenant, sublessee, subtenant or <br /> assignee. <br /> Section 13: "Limited common element' means a portion of the common elements allocated <br /> by the Declaration or by operation of G.S. 47C-2-102(2) or (4) for the exclusive <br /> use of one or more but fewer than all of the Units. <br /> Section 14: "Period of Declarant Control" means the period commencing on the date <br /> hereof and continuing until one hundred (100) percent of the Units have been <br /> conveyed, or the date upon which Declarant voluntarily surrenders control of the <br /> condominium, whichever date is first to occur, however, any Special Declarant <br /> Rights shall remain in force, to the extent applicable after one hundred percent of <br /> the Units have been conveyed. <br /> Section 15: "Person"means every natural person, corporation,business trust, estate trust <br /> 3 <br />
