a.If the insured has rights to recover all or part of any payment we have made under this Coverage Part, those <br />rights are transferred to us. The insured must do nothing after loss to impair them. At our request, the <br />insured will bring "suit" or transfer those rights to us and help us enforce them. <br />b.If the insured waives its right to recover payments for injury or damage from another person or organization in <br />a written contract executed prior to a loss, we waive any right of recovery we may have against such person <br />or organization because of any payment we have made under this Coverage Part. The written contract will <br />be considered executed when the insured's performance begins, or when it is signed, whichever happens <br />first.
